Legal experts predict definite Trump indictment after DOJ photo. Judge Napolitano: ‘It pains me to say it’

In the aftermath of the extraordinary FBI raid at Mar-a-Lago, Andrew Napolitano has reluctantly concluded that the politicized Biden Department of Justice will indict former President Donald Trump.

Former federal prosecutor Andrew McCarthy has also reached the same conclusion.

During an interview on Newsmax on Wednesday, former judge Napolitano explained to “The Balance” host Eric Bolling why he thinks Trump will face criminal charges.

Vindictive Democrat prosecutors have preordained the outcome, the former Fox News legal analyst implied in the video clip embedded above.

“I don’t think the government would’ve gone through this without planning in advance to indict him. It pains me to say it, and I don’t think he should be indicted. But I think the people that will make this decision have already made up their minds, and they’ll make this presentation to the grand jury right after the midterm elections…I hope I’m wrong,” the libertarian-leaning Napolitano asserted.

Unfortunately for the ex-POTUS, it will be a routine matter for the DOJ to obtain an indictment from a liberal D.C. grand jury or even a conviction from the same cohort down the line if it ever comes to that. The situation might be far different in another jurisdiction.

Both men agreed that the image of alleged top-secret documents strewn on the floor at Mar-a-Lago was staged by the DOJ, not the least of which is because Trump is a well-known “neat freak.”

In the conversation, Bolling referenced an op-ed authored by Napolitano in The Washington Times. In that essay, the ex-New Jersey Superior Court judge claimed that Trump is “in hot water.”

Even a cursory review of the redacted version of the affidavit submitted in support of the government’s application for a search warrant at the home of former President Donald Trump reveals that he will soon be indicted by a federal grand jury for three crimes: Removing and concealing national defense information (NDI), giving NDI to those not legally entitled to possess it, and obstruction of justice by failing to return NDI to those who are legally entitled to retrieve it…

 

Napolitano also opined that it’s untimely for the court to appoint a special master to review the documents, describing it as too little, too late, because the DOJ already has taken possession of the material. “The time to bring a special master in is during the raid on the house.”

In a lengthy article for the Never Trump publication National Review, the aforementioned McCarthy, a Fox News contributor added to the doom and gloom about the 45th president’s presumed legal woes.

McCarthy, who supported impeachment 2.0, seemed to acknowledge that politics is a factor, however.

“For some time, I’ve doubted the notion that the Justice Department is trying to make a case against Trump for mishandling classified information or illegal records retention based on the Mar-a-Lago search. But I’m less doubtful about the possibility of an obstruction case…Now that we’ve seen more of the government’s proof in this regard, I believe former president Trump is likely to be charged with obstruction of justice and causing false statements to be made to investigators. It does not appear that those charges would be difficult to prove…Trump’s better hope may be that he is more useful to Democrats as a badly compromised Republican presidential candidate than as a criminal defendant.”
