The agenda from radical leftists to promote the mutilation of children under the pretense of gender-affirming care is not readily surmounted while Democrats maintain control of Congress, but newly proposed legislation from Republicans is seeking to curtail its spread through a unique accountability check.
On Wednesday, Sen. Tom Cotton (R-Ark.) and Rep. Jim Banks (R-Ind.) plan to introduce the Protecting Minors from Medical Malpractice Act to provide an avenue for future legal challenges. The bill would allow adults who have had gender-transition procedures performed on them while they were minors to sue the medical practitioner up to 30 years after turning 18 on a number of grounds, according to a report from Fox News.
After establishing a definition for “biological sex” for the purpose of the bill to be, “the genetic classification of an individual as male or female, as reflected in the organization of the body of such individual for a reproductive role or capacity, such as through sex chromosomes, naturally occurring sex hormones, and internal and external genitalia present at birth, without regard to the subjective sense of identity of the individual,” it then goes on to utilize the varied forms of “affirming care” as set forth by the Department of Health and Human Services and promoted by Assistant Secretary Rachel Levine.

The bill would therefore permit suit from adults who have been prescribed hormone therapy treatments, placed on puberty blockers, or who had undergone “gender-affirming surgeries” such as a mastectomy, vaginoplasty or phalloplasty with exceptions made in the case of those born with chromosomal abnormalities.
“Unfortunately, radical doctors in the United States perform dangerous, experimental, and even sterilizing gender-transition procedures on young kids, who cannot even provide informed consent,” Cotton told Fox News Digital. “Our bill allows children who grow up to regret these procedures to sue for damages. Any doctor who performs these irresponsible procedures on kids should pay.”
President Joe Biden’s administration promotes “irreversible and life-altering surgery for minors too young to apply for a learner’s permit” Banks noted to Fox News. “These procedures lack any solid evidence and have been rejected by public health agencies around the world. Ten years from now, there will be hundreds of thousands of Americans who were permanently scarred by the radical Left’s agenda before they reached adulthood.”
The Indiana lawmaker suggested that the proposal of this legislation would prove if the left truly cares about the well-being of children and members of the transgender community by establishing a system of accountability. “If Democrats truly supported gender-confused children, they’d support our effort to give them legal recourse.”
However, the stance from progressives has seemingly fallen in line with activists within the movement like Levine, himself a man that identifies as a woman, who claimed “There is no argument among medical professionals — pediatricians, pediatric endocrinologists, adolescent medicine physicians, adolescent psychiatrists, psychologists, etc. — about the value and the importance of gender-affirming care.”
Florida Surgeon General Joseph Ladapo released his own fact sheet to counter Levine’s claims on the matter and decried the behavior of medical establishments pushing “political activism disguised as scientific advancement.”
As Fox News reported, Alabama began the enforcement of a ban on “gender-affirming” care for minors in May and Arkansas had sought the enactment of a similar ban that Gov. Asa Hutchinson (R) vetoed.
