The Supreme Court reinstated a woke admission policy at the Thomas Jefferson High School for Science & Technology in Virginia on Monday while the case is being appealed, despite a federal judge’s ruling in February that the practice is racist.

The Fairfax County School Board originally modified its admission policy following the death of George Floyd in May of 2020 in order to promote “equity” at the school, according to the Daily Mail.

The school has reportedly gone out of its way to up the percentage of black and Hispanic students attending the school since then. Asian-American parents claim the practice is racist and negatively affects their children who attend. The changes resulted in a lawsuit against the school board.

During a school board meeting in March, parents protested the “unfair” admissions process. A number of Asian American parents declared that the policy discriminated against their children considering that Asian students comprise more than 70 percent of the student body.

Supreme Court Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas supported the parents in the case’s argument and asserted that the court should have granted the request from the Coalition for TJ to suspend the admissions policy.

If the case comes before the high court as a full-blown judicial proceeding, it is likely to be struck down. The ruling on Monday was the court signaling that it will not get involved in the case just yet. The court elected, at this point, to not prevent Fairfax County Public Schools from using the admissions policy for the next school year.

Asra Nomani, who is a staunch anti-Critical Race Theory protester and whose child graduated from the school last year, asserts that the school made race a deciding factor in the admissions process. She claims that the school “systematically set out to reduce” the number of Asian students at the school.

Nomani is very disappointed with the ruling but is hopeful the case will prevail when it is brought back before the Supreme Court.

“Every American should be offended and outraged by the arrogance of the Fairfax County School Board in insisting on clinging to its state-sponsored racism and discrimination,” Nomani said, according to WUSA.

Nomani called it “unconscionable” that the school system defended its admission policies after a judge found them to be discriminatory.

“That’s nothing but systemic racism” against Asian Americans, she asserted.

So, racism really is being made systemic and is being championed by the “progressive” left. SCOTUS should rule on the actual core issue. Allowing it to drag out is harming kids.

The plaintiffs in the case claimed that increasing the percentage of black students at the school “had a substantial adverse impact on Asian American students… in order to achieve its desired racial balance.”

“We were hopeful that we would win this battle to vacate the stay in the highest court of the land, but our struggle for justice is not over. We are not at all dissuaded,” the Coalition for TJ said in a statement on Monday.

“…the U.S. Supreme Court decided not to step in to prevent Fairfax County Public Schools from using the admissions policy for next school year.” The case is now in the 4th Circuit of Appeals, where FCPS is appealing the federal judge ruling that the new admissions is illegal.

“Today’s action by the U.S. Supreme Court will allow a race-blind and fair admissions process to proceed for this fall’s entering freshman class at the Thomas Jefferson High School for Science and Technology (TJ) while the Fourth U.S. Circuit Court of Appeals in Richmond considers the underlying appeal. The Fourth Circuit has approved Fairfax County Public Schools’ request for an expedited schedule to resolve the legal issues involved in the admissions process,” Fairfax County Public Schools said, according to ABC 7 News.

“We continue to believe our new plan for TJ admissions is merit-based and race-blind,” proclaimed FCPS Division Counsel John Foster. “We are confident that after considering the facts and the law, the appeals court will decide that our plan meets all the legal requirements and guarantees every qualified student will have the chance of being admitted to the finest public science and technology high school in the country.”
