Five Democratic members of West Chester School Board in Pennsylvania were immediately removed on Tuesday by Chester County Judge William Mahon after they voted to make masking mandatory in the beginning of the school year.
A petition, co-written by Beth Ann Rosica, a parent, claimed that the school board had no authority to impose a mask mandate within the school. President Sue Tiernan, Joyce Chester, Kate Shaw, Karen Herrmann, and Daryl Durnell reportedly failed to respond, and were subsequently removed from their posts, Fox News reported.
Following the end of the state of emergency, the state’s Supreme Court determined that mask mandates were unconstitutional.
“Once the Supreme Court declared that was unconstitutional we implored our school board, we asked and asked and begged and pleaded and made comments to lift the mask mandate, and they refused,” Rosica explained to WHYY. “When they refused, that is when we made the decision to file the petition.”
“I did not believe they had the legal authority to mask our children. I want to ensure they will never be forcibly masked again,” she added.
Just because they were removed, however, doesn’t mean they aren’t going to fight Judge Mahon’s decision. The attorney for the group, Kenneth Roos, says they have submitted a motion to reconsider the decision which would extend their date to respond to April 15.
Superintendent Dr. Robert Sokolowski made a statement on the removals, calling them procedural. The statement was noticeably devoid of anything addressing the mask mandate.
“While we do not have all of the answers at this time, please be assured that the West Chester Area School District and I remain deeply committed to the mission of educating and inspiring the best in our students,” he assured the community.
Rosica and the school board will have seven days to submit a list of potential replacements for the now-vacant seats.
