This New Jersey Donald Trump supporter just won big for free speech!
Joseph Hornick was ticketed in March for daring to fly a Trump flag outside of his home in West Long Branch, New Jersey. Local officials cited an ordinance they claimed prohibited Hornick from flying the flag, stating that residents could only post political signage 30 days before the election.
But, Judge Louis Garippo Jr. said the language of the ordinance was “somewhat vague,” and dismissed the case, ultimately allowing Hornick to fly his Trump flag whenever he sees fit, according to NJ.com.
“This matter is dismissed,” Garippo said. “I’ve looked at the ordinance as well, and I agree with counsel it’s somewhat vague as to whether the flag applies or not. So in the interest of justice, this is dismissed.”
Hornick is now celebrating by flying his Trump flags again, taking on the haters who have ripped his flag down five times in order to impede his right to free speech.
“Let them come, let them rip those flags down because I have a warehouse on alert, and I’ll put up a flag every time they tear one down,” Hornick said.
“Let the flags fly. Let ’em fly,” Hornick said. “You take my freedom away, I’d rather sit in jail, bottom line.”
Hornick’s legal team said the win was for free speech, first and foremost.
“That’s really what’s important here – that the First Amendment protects their right to post their signs. And especially in a presidential year we know that there will be a lot of folks who will be expressing their viewpoints,” said Jeanne LoCicero, deputy legal director of the ACLU-NJ who worked with Hornick.
“We hope that New Jerseyans around the state know that they can do this and if any other towns are out there with these kinds of ordinances, we hope that they will reconsider them and we’re prepared to assist anyone who has these problems,” LoCicero said.
