The key witness in Manhattan District Attorney Alvin Bragg’s malicious prosecution of former President Donald J. Trump testified before a grand jury on Monday and dealt a major blow to the credibility of disgraced attorney Michael Cohen.
Robert Costello, a former legal adviser to the convicted felon who is the prosecution’s star witness against Trump described Cohen as a “convicted perjurer” and a “serial liar” in testimony that in a normal setting and not virulently anti-Trump New York City, could sink the case entirely.
“There can be no doubt in anyone’s mind that Michael Cohen has great difficulty telling the truth,” he said. “He is, after all a convicted perjurer, and our track record with Mr. Cohen convinced us that he was a serial liar.”
“As might be expected, Mr. Cohen’s lies were always uttered in a way that was beneficial to himself,” Costello added. “When it was in Mr. Cohen’s personal self-interest, he was capable of telling the truth, but those occasions were few and far between.”
Cohen responded to Costello’s impugning of his credibility in a statement to Fox News Digital, saying if “Bob Costello’s comments were any more fantastical, he would be a bestselling fiction author.”
“It is important to note, I never slept with Stormy, I stated years ago that the payment was done at the direction of, in coordination with and for the benefit of Donald,” he told the outlet. “Truth is truth and the documents in the possession of the DANY demonstrate this.”
Costello further elaborated during a Fox News appearance when he joined host Tucker Carlson on Monday night’s edition of “Tucker Carlson Tonight” after he delivered his testimony to the grand jury.
“Michael Cohen, in my opinion, was lying about just about everything. I specifically told them there were two main points that I wanted to make clear,” he said. “That Cohen had told us that when we first met him that he was suicidal.”

“Why is that important? Because when you’re suicidal, thinking that that’s the only way out of your legal mess, and you’re presented with the following options, that you can cooperate against Donald Trump and provide information that would get you a get-out-of jail-free card and you respond to us, ‘I do not have any information Donald Trump,’ and he said it many times during that two-hour meeting, ‘I swear to God Bob, I don’t have anything on Donald Trump.’
“And I had my law partner who knew Michael Cohen for ten years on Columbia Grammar and Prep School here in Manhattan because Cohen was on the board of directors,” he continued.
“And when I heard him say that he was suicidal, the weekend before, standing on the roof of the Regency hotel,”he said, referring to a conversation that took place in 2018 after the FBI had raided the lawyer’s office. “I didn’t know whether he was a drama queen or telling the truth so I looked at my partner and he shook his head and nodded, ‘I think he’s telling the truth,’ and later on we got that corroborated by the Reverend Jerry Falwell and his wife who had dinner with Michael Cohen and told him the same thing.”
“Why is that important?” Costello asked. “Because when you’re willing to give up your life in order to avoid these legal troubles, when they’re insurmountable to you, and you’re offered a way out so all you have to do is cooperate on Donald Trump, ‘do you have anything on Donald Trump?’ and he says no, repeatedly, ‘I swear to God Bob, I don’t have anything,’ then you know, that you’ve got a guy who probably doesn’t have anything.”
“It’s certainly easier to give up information on Donald Trump than it is to kill yourself,” he said. “On top of that, while he’s making these speeches during a two-hour period, he’s marching up and down on the other side of the conference table like a tiger in the zoo. Back and forth, back and forth, back and forth, he looked like he hadn’t slept in five days, he looked like somebody who was suicidal.”
“And every once in a while, he would stop and point at us,” Costello recalled, “when I say once in a while, he did this at least twenty times and said, ‘Guys, I want you to know I will do whatever the f- I have to do, I will never spend one day in jail.'”
“Now, what he’s saying is I’ll lie, cheat, steal, shoot somebody, I not spend a day in jail. Do you think a guy whose mentality is that is going to not admit that he has information on Donald Trump?” Costello asked.
Cohen would go on to be convicted and sent to the Federal Correctional Institution at Otisville, New York, a facility that was described by Forbes as one of “America’s cushiest” prisons. He was released in 2021 after serving about 13 1/2 months of a three-year sentence.
