Man who defended home with ‘AK-47 style’ gun will ‘absolutely not’ face charges, FL sheriff says

A Florida man will face no charges for reportedly opening fire on three alleged home invaders in an incident that occurred in the Pensacola area shortly before midnight on July 7.

According to Escambia County, Fla., Sheriff Chip Simmons, one of the alleged intruders was reportedly armed with a handgun.

The victim, who was home alone and was reportedly shoved by the alleged assailants, also had a handgun that apparently slipped out of hand. That firearm was picked up by another one of the intruders. This meant, as Simmons implied, that the homeowner now had two armed adversaries in his home.

In a Facebook video, Simmons explained that the victim allegedly ran to a back room, retrieved an “AK-47 style gun,” and began shooting at the alleged home invasion suspects “to get them out of his house and to protect himself.”

The triumvirate then fled the residence. The sheriff added that one man may allegedly have suffered a non-life-threatening gunshot wound to the head in the general time frame, and that scenario is under investigation.

“The stories he’s giving us as to how he got shot in the head are inconsistent at best. In short, we don’t believe him. So what we’re looking at is to determine whether this is the third person that was involved,” the lawman asserted.

As alluded to above, in the context of any potential legal jeopardy for the homeowner for shooting at the intruders, Sheriff Simmons emphatically ruled that out: “Absolutely not,” he said.

“The homeowner is protecting himself. And in Florida, in Escambia County, you can protect yourself,” he added.

Authorities apparently were able to identify three suspects, two of whom have an arrest history and allegedly were already subject to prior active warrants. One of the suspects is age 18 and another is 20.

Deputies subsequently made two arrests.

“This is being investigated as a Stand Your Ground case, so the homeowner will not be charged because of self-defense,” CBS affiliate WKRG reported on Friday.

Parenthetically, if they had their way, Democrats would likely ban the AK-47, among other so-called assault weapons.
