The wife of a seriously ill man hospitalized with COVID-19 has abandoned her legal quest to gain access to ivermectin for her husband.
She has reportedly decided against appealing a court decision that sided with a New York City healthcare facility that refused to administer the controversial drug.
“Erika Quintero-Sherry, 48, on Tuesday dismissed her January suit against Mount Sinai Hospital, which asked a judge to force the facility to give her rabbi husband Benjamin Chernyavsky the controversial drug that isn’t FDA approved as a treatment for COVID-19,” the New York Post reported.
“Last week, Manhattan Supreme Court Justice Lynn Kotler denied the wife’s bid for an emergency order for the hospital to administer ivermectin following two days of hearings from Mount Sinai doctors who advised against using the drug. They said Chernyavsky likely is no longer infected with COVID-19 but rather fighting the effects the disease inflicted on his body,” the news outlet added. “‘Indeed, the record reveals that if prescribed ivermectin, Mr. Chernyavsky’s condition may very well worsen,’ Kotler’s decision read.”
Chernyavsky, 60, a father of five, is currently on a ventilator in a medically-induced coma and with an apparent 20 percent chance of surviving.
Quintero-Sherry’s lawyer implied that given the gravity of the situation and that the wheels of justice move slowly, there just wasn’t enough time to pursue the appeal in her lawsuit.
“Weighing the potential and weighing the cost and the time frame – the clients made the decision not to go through the appeal,” Attorney Ralph Lorigo told the Post. “If you are not successful at the emergency motion – you just don’t really have the time to accomplish anything.”
Mount Sinai is relying on guidelines from the U.S. Food and Drug Administration. “The FDA has not authorized or approved ivermectin for the treatment or prevention of COVID-19 in people or animals. Ivermectin has not been shown to be safe or effective for these indications,” the agency says on its website.
Designed to address parasitic infections such as malaria, the two scientists who developed the drug received the Nobel Prize in 2015.
A study released earlier this month by the Journal of the American Medical Association involving 241 COVID patients indicated that ivermectin “does nothing to prevent the disease from progressing.
Other studies are ongoing.
Various doctors and scientists in the U.S. and around the world, however, have insisted that the medication is effective against the coronavirus in off-label use.
Ivermectin use or nonuse has prompted legal challenges across the country.
Unlike the outcome in the New York case, an Illinois family went to court in December 2021 and obtained an order forcing a hospital to administer ivermectin to a 71-year-0ld “desperately ill” father.
His loved ones say that the drug enabled him to fully recover.

Whether for political reasons or other considerations which may or may not be based on science, many public health officials and the vaccine-or-nothing corporate media appear hostile to the use of ivermectin or other therapeutics to COVID patients.
Recall that influential podcasters Joe Rogan seemed nearly on the verge of cancellation in part for discussing ivermectin and other alternative treatments.
