In an attempt to nail former President Trump and his family for alleged financial fraud, New York Attorney General Letitia James has subpoenaed Ivanka and Donald Trump Jr., while Trump contends the investigation is a violation of his constitutional rights.

The subpoena seeks “testimony and documents ‘in connection with an investigation into the valuation of properties owned or controlled by Donald J. Trump or the Trump Organization, or any matter which the Attorney General deems pertinent.'”

Unsurprisingly, The New York Times has managed to get a hold of a court filing stating that former President Trump and his two children were served in early December. This follows Trump moving to sue James last month, asserting that her investigation is unconstitutional.

“Neither Mr. Trump nor the Trump Organization get to dictate if and where they will answer for their actions,” James said in response to the lawsuit filing.

Trump’s legal team is attempting to block James’ probe. The attorney general’s investigators want to depose Trump and both of his children.

ABC News is now reporting that Ivanka and Donald Trump Jr. are both refusing to comply with the subpoenas. Trump, his family, and his organization have denied any wrongdoing and argue the investigation is purely political in nature.

The legal filing that disclosed the subpoenas on Monday was also signed by the judge who presided over an earlier court action brought by the attorney general’s office that forced the Trump Organization to turn over records.

The filing lays out a schedule for attorneys for all three Trumps to file motions that would seek to quash the subpoena or otherwise modify them, and for James’ office to reply to those motions. Lawyers for the Trumps have agreed to that schedule.

“A dispute has arisen between the OAG and the Individual Trump Parties regarding the Subpoenas,” a document filed Monday asserted.

Donald Trump Jr. and Ivanka Trump will file motions to quash the subpoenas as soon as Monday, the filing indicated. Alan Futerfas, an attorney for Donald Trump Jr. and Ivanka Trump, and Ronald Fischetti, who represents Donald Trump, confirmed the move to quash the subpoenas.

Eric Trump was previously grilled by James’ investigators in 2020. She has dug in her heels on the investigation and is going after anyone she can to try and nail the former President.

Trump’s organization is being accused of fraudulently inflating the value of his assets to hoodwink lenders while at the same time understating his value to allegedly avoid taxes.

James is also assisting Manhattan district attorney Cyrus Vance with that office’s investigation into Allen Weisselberg, the Trump Organization’s chief financial officer, for alleged tax crimes.

Prosecutors are claiming the company paid Weisselberg’s rent, living expenses, private school tuition, and car lease without proper reporting on tax returns. Both pleaded not guilty.

Both investigations have been going on for a long time as New York looks to somehow get their pound of flesh out of the Trump family and organization. So far, they have not been successful.
