Republicans prepare to sue Biden over hypocritical gun control, point to son Hunter’s gun incident

Republican lawmakers threatened to take legal action Thursday against President Joe Biden’s gun control executive orders while calling out perceived hypocrisy over Hunter Biden’s own gun incident.

Biden announced provisions that would crack down on ghost guns, restrict the use of handgun braces, expand Red Flag laws, spend more money on community gun violence, and mandate gun trafficking reports. He’s also taking aim at banning “assault weapons,” making background checks tougher, and stripping gun manufacturers of protections under the law.

House Minority Leader Kevin McCarthy called the new executive orders and proposals “unconstitutional” and promised that he would pursue “every option” to negate them.

Donald Trump Jr. and Dana Loesch are both going after Biden’s purported hypocrisy over gun control in connection to Hunter Biden’s handgun incident in 2018. Joe Biden’s daughter-in-law, Hallie Biden, reportedly took a gun that Hunter Biden had bought and tossed it into a garbage bin behind a grocery store. She went back later to retrieve the weapon but it was already gone. The gun would eventually be returned by a man who had been going through the dumpster for recyclables and had found it there.

A sticking point in the whole affair is that Hunter Biden’s receipt for the gun indicated that he had answered “no” when asked: “Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?” Biden has freely admitted he was a drug addict publicly and in a book that he just wrote. He was also discharged from the Navy for using cocaine.

“Biden wants to disarm law-abiding American citizens with unconstitutional gun control measures, but his son Hunter is allowed to break the law and lie on federal background check forms to get a gun with no consequences???” tweeted Donald Trump Jr.

Conservative commentator and author Dana Loesch also tweeted: “Does it include bringing charges against members of his family for stealing a handgun and falsifying a 4473?”

McCarthy indicated that legal action would be forthcoming over the gun control measures: “President Biden has ordered the [Justice Department] to issue new rules that will surely result in unconstitutional overreach. Republicans will strongly oppose and pursue every option—be it legislative or judicial—to protect the right to keep and bear arms from infringement by this Administration.”

The legal fight over the Biden administration’s gun control moves is starting to seriously gain speed. Especially with the president’s apparent overt attack on the Second Amendment rights of Americans:

“Nothing I’m about to recommend in any way impinges on the Second Amendment,” Biden stated. “These are phony arguments suggesting that these are Second Amendment rights at stake from what we’re talking about.” Biden added: “But no amendment to the Constitution is absolute … From the very beginning, you couldn’t own any weapon you wanted to own. From the very beginning the Second Amendment existed, certain people weren’t allowed to have weapons. So the idea is just bizarre to suggest that some of the things we’re recommending are contrary to the Constitution.”

Other Republicans were alarmed and warned of legal implications concerning Biden’s actions.

“Today, President Biden announced his attempts to trample over our constitutional Second Amendment rights by executive fiat,” Sen. Mike Crapo (R-ID) declared.

South Dakota Gov. Kristi Noem also stepped up to the plate: “Taking away guns with Red Flag laws is an infringement,” she tweeted. “Placing new limits on firearms sales is an infringement.”

West Virginia’s Republican attorney general, Patrick Morrisey also threatened litigation. “Defending the Second Amendment remains one of the most important priorities for the West Virginia Attorney General’s Office,” he remarked. “I will not allow the far left to run roughshod over our citizens’ gun rights. If President Biden follows through on his proposals, we will be in court very quickly.”

Sen. Ted Cruz (R-TX) weighed in: “The right to keep and bear arms is fundamental for preserving our liberty. The answer is not to restrict the Second Amendment rights of law-abiding citizens, the answer is to go after violent criminals and come down on them like a ton of bricks.”

Rep. Lauren Boebert called on Republican attorney generals to prepare for a legal fight as well. She also referred to Biden’s actions as those of a “tyrant.”

Rep. Marjorie Taylor Greene flatly stated: “The right of the people to keep and bear arms SHALL NOT be infringed!”
