A federal judge in Chicago enjoined enforcement Friday of a Justice Department directive that withholds federal funds from so-called sanctuary cities.
U.S. District Judge Harry Leinenweber, a Ronald Reagan appointee, issued a nationwide injunction staying the program while it is evaluated by the courts.
“The court finds that the city has established that it would suffer irreparable harm if a preliminary injunction is not entered,” Leinenweber wrote according to Bloomberg. Leinenweber extended the order to jurisdictions around the country, “there being no reason to think that the legal issues present in this case are restricted to Chicago.”
Chicago Mayor Rahm Emanuel brought a challenge against the law to protect the city’s status as a sanctuary jurisdiction.
The directive, which Sessions issued in July, requires that all recipients of the Edward Byrne Memorial Justice Assistance Grant must comply with a federal law mandating information sharing with federal immigration officials. It also permits Department of Homeland Security access to detention facilities to interrogate immigrants and notify DHS 48 hours prior to release of individuals suspected of immigration violations.
