A statement from Special Counsel Richard Sauber released Saturday confirmed five more classified documents were located at President Joe Biden’s Delaware home, adding further weight to the scandal while also drawing attention to the disparity regarding the Justice Department’s investigation of former President Donald Trump.
Last May, the White House tapped Department of Veterans Affairs attorney Sauber to join Biden’s government legal representation expecting investigations to occur should the Republicans regain control in Congress. Now, after it was revealed that classified documents were discovered before the midterm elections from Biden’s time as vice president at his former office at the University of Pennsylvania, and more recently at his home in Wilmington, Delaware, Sauber has been deployed to attempt to protect the president from the growing scandal.
As such, on Saturday, the attorney released a statement disclosing certain details about the investigation and the fact that five more documents were located at Biden’s home on Thursday.
“Because I have a security clearance, I went to Wilmington Thursday evening to facilitate providing the document the President’s personal counsel found on Wednesday to the Justice Department. While I was transferring it to the DOJ officials who accompanied me,” Sauber explained, “five additional pages with classification markings were discovered among the material with it, for a total of six pages. The DOJ officials with me immediately took possession of them.”

To begin, the attorney talked up Biden’s cooperation with the National Archives and Records Administration and contended everything was on the up and up.
“President Biden’s personal attorneys have followed a process, coordinated with the Archives and the Department of Justice, to review documents at the Penn Biden Center and the President’s Delaware residences,” he said.
However, he immediately raised concerns over potential impropriety as he admitted, despite the Justice Department’s knowledge that classified documents were discovered in November, that individuals without clearance were reviewing files stored at Biden’s home.
“The President’s personal attorneys conducting the searches do not have active security clearances, so they identified a document with a classified marking, they stopped and did not review it, and suspended any further search in that box, file or other specific space where the document was found, as appropriate,” he said.
Readily ignored was the contrast in the investigation compared with the FBI descending upon Trump’s residence at Mar-a-Lago where, per a statement from Trump, attorneys were not permitted oversight.
“They demanded that the security cameras be turned off, a request we rightfully denied. They prevented my attorneys from observing what was being taken in the raid,” the former president contended, “saying ‘absolutely not.’ They took documents covered by attorney-client and executive privilege, which is not allowed. They took my passports. They even brought a ‘safe cracker’ and successfully broke into my personal safe, which revealed…nothing!”

“Since the DOJ made contact with the President’s personal attorneys, the next step in the process was to notify DOJ and to arrange for DOJ to take possession of the document,” Sauber further detailed the process, which was civil by contrast. “This is what occurred in Wilmington on Wednesday when the President’s personal attorneys discovered one document with a classified marking consisting of one page in a room adjacent to the garage. At that point, the President’s personal attorneys stopped searching the immediate area where the document was found.”
After reporting that the DOJ was now in possession of the files, the attorney further lauded Biden’s legal team and stated, “The President’s lawyers have acted immediately and voluntarily to proved the Penn Biden documents to the Archives and the Wilmington documents to DOJ. We have now publicly released specific details about the documents identified, how they were identified, and where they were found. The appointment of the Special Counsel in this matter this week means we will now refer specific questions to the Special Counsel’s office moving forward. As I said Thursday, the White House will cooperate with the newly appointed Special Counsel.”
Sauber’s statement did not speak to concerns raised by Fox News White House correspondent Peter Doocy and others about why Biden decided to spend this weekend at his Delaware home, “isn’t that a potential crime scene?”
Doocy went on to say Friday that “there were more questions about other topics besides the documents, growing document scandal–I think we can call it a scandal at this point–and so it’s unclear how much more there is gonna be, how much more new information we’re gonna get from this White House about any of this other than they ‘take it seriously’ and that they’re ‘gonna cooperate.'”
Other concerns remain regarding who had access to the residence as the White House has refused to produce a visitors log for the home where Biden has spent more than 150 days of his presidency, and which his scandal-ridden son Hunter Biden had listed as his address as recently as 2018.
