Judge Napolitano calls imprisonment of Jan. 6 protesters an ‘American gulag’: ‘None of them should be in jail’

Andrew Napolitano gave an explosive interview Thursday on “The Joe Hoft Show” at the Real Talk radio network and bluntly asserted that the Jan. 6 protesters should not be in jail, that they should all be out on bail, and called their imprisonment an “American gulag.”

None of them should be in jail. They should all be out on bail. Most jails are garbage, particularly inner-city jails. There’s no political support for spending a nickel in there. Politicians don’t care because the public doesn’t care. So it shouldn’t be a surprise,” Napolitano candidly noted.

“But what’s surprising is that they have been attacked violently and that they’ve been subjected to a disgusting environment for more than a few hours and that they’re in jail, to begin with,” he stated.

“I mean none of these people is a threat to society and all of them would gladly come back at the time of trial and most of them shouldn’t be charged anyway because most of them were there to engage in 1st Amendment protected behavior,” Napolitano charged.

Napolitano went on to discuss a piece by political consultant Roger Stone concerning the horrific stories of those who have been kept in the DC jail and then the Virginia state jail system.

“I read a piece, I think this morning, by our mutual friend Roger Stone, which is just heartbreaking as to the things that are going on in the DC jail and in the Virginia state jail which is basically controlled by the feds,” he began.

“The Feds are trying to wear these people down. They’re way overcharging them so they can get guilty pleas and they’re making their lives miserable so that the defendants will say to their lawyers, you know, ‘Get me out of here, I’ll agree to testify to anything, just so I can have a decent night sleep and a decent shower and a decent meal.’ It shouldn’t be that way. It is an American gulag and it’s political. It’s a Democratic DOJ torturing conservative Republicans that were expressing their belief whether well-grounded or not… but their firmly held belief that Trump was reelected and the electoral count should not proceed,” the former judge charged.

“Judges don’t like to tell jailers how to run their jails but when it’s a violation of a constitutional right, the judges should. The judges should be releasing these people, like I said. They should be released on a moderate amount of bail because the Constitution prohibits requiring an unreasonable amount of bail… The overwhelming majority are not accused of an act of violence… There’s every indication that these people should be given bail, but they’re not,” he contended.

“Judges are not doing their job. This stuff should make its way to the Supreme Court of the United States which rarely hears matters involving bail or conditions in prison unless a cause of death. But it needs to be exposed and it needs to be corrected,” Napolitano declared.

  1. Give credit where credit is due. I stopped listening to him when he was on Fox, but he gets this one right.
    I won’t donate to cash rich MAGA or the RNC until they help correct this third world tragedy. Lots of talkers who are willfully blind. $$$, it’s all about the $.

  2. This is quite a statement from a not too bright judge. I wonder who helped him formulate this? Obviously he did not on his own.

  3. There is a difference in the last 15 months between the way black criminals are handled and the way white conservatives or Republicans are handled. Many black violent criminals are released with NO bail, or plea down to misdemeanors or even infractions for serious crimes. Black violent criminals with long violent arrest records are being let out of prisons all over America by the hundreds of thousands to prey on society again. Many black criminals due to the fear of BLM retaliation are not even charged, just let go. The Jan 6 prisoners are America’s First true “political prisoners”- of the Left and Democrats-who should have been cited for trespass, and those that did more serious crimes charged and arrested, but given bail and released. Most of the folks in Jan 6 “riot” were just naive people caught up in a mob mentality that got out of hand. Most just walked around the capitol, they did not destroy anything or hurt anyone. How many of the BLM and ANTFA Domestic terrorists who rioted 534 times in 2020 and caused BILLIONS of dollars of damage, committed assaults and even murder-were arrested? None of the Jan 6 protestors should have been imprisoned and subjected to inhumane treatment for over 1 year – like most were-with NO rights. I wish some top notch attorneys would represent these folks in a class action suit against the Biden admin, and sue them for the un-American treatment of these political prisoners-it is one of the worst violations of our Constitution maybe ever.

  4. I agree with the Judge. IMO, these people are PELOUSY’S political prisoners, and I hope they sue the hell out of her and her so-called committee, the FBI, and Capitol Police when they get the chance. We’ve seen how the FBI were involved in the Whitmer kidnapping farce, and how Strzok, Comey etal., operated, and IMO, we need a new FBI, and some of the Capitol Police need to go. The one who shot ASHLI BABBITT needs to be charged with murder, IMO, instead of receiving a medal. He hasn’t even been charged or tried, but is still on the job. IMO, if ever there was a bad shoot by an officer, that shot was one of them. IMO, the FBI needs a new leader too, because the one now seems to be a do-nothing keeping his seat warm, and a friend of Comey. I have read about the condition that they are being held in, and without even being charged for a very long time, and IMO, that should never happen in America. They appeared to be welcomed into the Capitol that day, and the trouble that was caused, I believe probably was preplanned, probably involved some FBI, BLM, and Antifa. My opinion, but I believe it. BTW, WHO IS RAY EPPS???

    It was blown up to be by the donkey party to try and destroy President Trump.
    It was a protest and even the security was egging them on to enter .
    All collaborated
    These people should be released .

  7. are there no dc judges willing to speak for these prisoners and getting them released. the prisoners have suffered far more already regardless of any actions they may have taken on jan 6th..

  10. That American citizens have been held unconstitutionally and without bail for over a year and a half is the greatest travesty of American justice that I have ever seen. At worst they are being held on trumped up trespassing charges but the prolonged illegal incarceration will force many to plead guilty to other offenses. Meanwhile BLM and Antifa destroyed cities, caused billions in damages and actually killed people but most went Scott free. The Jan. 6 commission are the real “insurrectionists” and “seditionists”.

  11. Someone needs to point out the Jan 6 commission is aiding and abetting the unconstitutional jailing of a great number of people who do not belong in jail. That is a felony. Virtually every member of the illegal committee is a lawyer andknows it violates the rules of the House. They also know that holding all these people who have not been charged is a violation of Habeas Corpus, but have failed to take any corrective measures. For that they are all civilly liable and need to be sued as a committee and individually. FJB

He did everything he could to help this lawless administration and congress get elected and he has the nerve to come out and condem the consequences of his stupidity. He has absolutely no credibility on anything to do with the criminal justice system. FAN!

  13. Whenever democrats are in charge of “justice,” you can bet there ain’t gonna be any justice happening. Their problem with it is that it is meant to apply equally to everyone, including the political enemies of democrats, and they simply cannot abide that. So they replace it with tyranny and call it justice.
