The Milwaukee County court system has irretrievably lost the transcript of the prior bail hearing for the Waukesha Christmas parade massacre suspect Darrell Brooks which resulted in him being set free just ten days before the horrific attack.
Brooks was released on $1,000 bail after he allegedly ran over his ex-girlfriend with his red Ford Escape on Nov. 2, two weeks before the parade rampage. Somehow, the court claims there was a glitch and his transcript was permanently damaged, an official told Fox News Tuesday.
“The digital recording is damaged,” she claimed after an attempt was made to order the Nov. 5 transcript for review. A court administrator told Fox5, “There are no recordings” due to “technical issues.”
Milwaukee County intake courts, where bail is generally set, are digitally recorded. The court records online show “digital recording” and “video conferencing” next to the hearing where Court Commissioner Cedric Cornwall set Brooks’ bail at $1,000. He posted the reference on Nov. 11, according to Wisconsin Right Now.
“We saw this coming,” Jackie Rupnow, who is with the Wisconsin Court Reporters Association, told Fox News. “It’s crucial, and now, there’s no record of it.”
Rupnow contends that the association warned the state Supreme Court two years ago that digital recordings should be closely monitored by trained professionals and they ignored the warning.
Brooks has a rap sheet that exceeds 50 pages in length going back to 1999. He’s a career criminal. Despite all of that and another pending felony case for shooting at his nephew during a fight in July of 2020, a junior prosecutor unbelievably decided to recommend $1,000 cash bail for Brooks. Court Commissioner Cedric Cornwall went along with the recommendation. His mother immediately bailed him out.
Brooks was granted ridiculously low bail even though he scored 6 out of 6 on a risk assessment of new criminal activity and a 4 out of 6 on a failure to appear in court test, according to court documents.

It should be noted that Brooks has served time in prison for convictions related to domestic violence, raping and impregnating a teenager, firearms, drugs, and battery.
He would go on to use the same car when he plowed into parade participants and bystanders in Waukesha, Wisconsin, killing six and injuring more than 60 according to authorities.

Milwaukee County District Attorney John Chisholm immediately announced an internal investigation into the inadequate bail amount set by the junior prosecutor following the tragedy.
“The state’s bail recommendation, in this case, was inappropriately low in light of the nature of the recent charges and the pending charges against Mr. Brooks,” Chisholm remarked in a statement.
The district attorney in the case is a self-described progressive. He has actively advocated for reforms that reduce cash bail and incarceration rates.

“Is there going to be an individual I divert, or I put into treatment program, who’s going to go out and kill somebody?” he reportedly told the Milwaukee Sentinel-Journal back in 2007. “You bet. Guaranteed. It’s guaranteed to happen. It does not invalidate the overall approach.”
Brooks’ bail has now been set at $5 million and he is residing in the Waukesha County Jail facing six counts of intentional homicide and a slew of other charges.
