The eviction moratorium — Now is the time to stop Biden tyranny

Op-ed views and opinions expressed are solely those of the author.

Biden and friends are testing the waters to see how much tyranny the American public will tolerate. I am referring to the latest power grab by the administration—the ruling by the Centers for Disease Control and Prevention (CDC) that there will be an extension to the moratorium on eviction of tenants.

The White House previously acknowledged that the president does not have the authority to extend the existing moratorium because the Supreme Court ruled that only Congress can do it. In a devious move right out of Machiavelli, Biden handed the ball to CDC Director Rochelle Walensky. Unilaterally extending the moratorium to October 3rd, Walensky justified her decision on the alleged grounds that the evictions of tenants for failure to make rent or housing payments could be detrimental to public health control measures for slowing the spread of COVID.

Based on the Supreme Court ruling—that “clear and specific congressional authorization” is required to extend the moratorium—the arbitrary decision by the CDC is clearly illegal and unconstitutional. That hasn’t stopped Biden & Company. Sen. John Kennedy of Louisiana warned that the Constitution is just a nuisance to Biden and his Deep State controllers.

The new modus operandi of the Democratic Party is to ignore the Constitution when it serves their purpose. “The CDC has the power to extend the eviction moratorium,” claimed House Speaker Nancy Pelosi. “[Pelosi] didn’t explain where that power comes from,” said Tucker Carlson on his August 4th Fox News TV show. “She simply declared that it exists, as dictators do.” Rep. Maxine Waters agreed with Pelosi. “I don’t buy that the CDC can’t extend the eviction moratorium,” Waters tweeted. “Who is going to stop them? Who is going to penalize them?”

If they aren’t stopped, kiss the country goodbye. “The CDC does not make laws in this country. It’s not allowed to,” said Carlson. “Under the U.S. Constitution, making laws is the exclusive role of Congress.” Apparently that is no longer true. “Rochelle Walensky now makes the laws,” Carlson explained. “Walensky announced today that she has decided to nationalize America’s rental properties. Where did she get the power to do this, to suspend private property rights in America? The answer is, she simply asserted the power and no one stopped her from exercising it.”

The critical question that has yet to be answered is, who is going to enforce the CDC ruling? The Biden administration can get away with this only if Walensky’s ruling is enforced by local governments and the Justice Department. Challenges to the ruling are in progress. Two groups representing property owners have asked a federal judge to block enforcement of the extension. According to NBC News, “The groups argued that the CDC ‘caved to the political pressure’ after Democrats pressed the White House over the weekend to extend the moratorium. The groups claimed the agency issued the new order ‘for nakedly political reasons—to ease the political pressure, shift the blame to the courts for ending the moratorium, and use litigation delays to achieve a policy objective.’”

What does this mean for the U.S.? “It’s hard to overstate what a momentous change this is,” said Carlson. “It means among other things that private property no longer exists in the United States. You thought you owned your home. Not anymore. Rochelle Walensky does. She’ll decide who can live there, under what circumstance and for how long. An unelected college professor you hadn’t heard of six months ago is now in charge of your country.”

What comes next? If Biden gets away with this blatantly tyrannical move, what else will he try? He is in the process of violating U.S. immigration laws with his secretive border policy. I believe Biden is taking the first steps in what may turn out to be a complete takeover of the federal government by the left-wing of the Democratic Party. The time to stop them is now. If the CDC ruling is met with a lack of enforcement, that would be a good first step.
