Former Secret Service agent Dan Bongino presented evidence on his show Friday suggesting former President Barack Obama was behind the “astonishing set-up” of former national security advisor Mike Flynn.”

Taking to Twitter to promote the show, Bongino tweeted: “Obama Did It. Here’s the evidence, his fingerprints are all over the Flynn scandal.”

Bongino cited an Epoch Times article that said “the name of Michael Flynn wasn’t masked to protect his identity in transcripts of his calls with a Russian ambassador that were distributed or revealed to President Barack Obama and a number of top officials in his administration.”

So, if there was no masking of Flynn’s December 29 call with Russian ambassador Sergey Kislyak, Bongino asked how did the transcript of the call get out.

Pointing to “two gems” in the article, he highlighted an important question: “Who the hell ordered Mike Flynn’s transcript for his call with the Russians  — if it ain’t a FISA warrant, it ain’t a criminal warrant, and it most certainly wasn’t an unmasking, how did we get it?

Gem #1:

Comey said the calls “turned up … at the end of December, beginning of January.”

Then-Director of National Intelligence James Clapper requested copies from Comey and then briefed Obama, his Vice President Joe Biden, and Obama’s senior staff about the calls, Comey said.

The relevant question here, according to Bongino, is how did the call “turn up?”

“What? Is this a scavenger hunt?” he asked. “What are we searching for Easter eggs around Easter that the Easter Bunny left behind? What do you mean they turned up? A call with the incoming national security advisor and a Russian diplomat, Kislyak, just magically turned at the FBI.”

“How?” he continued. “There’s no FISA warrant, there’s no criminal warrant, there’s no unmasking request until January 4th.”

Bongino stressed that the story-line has been that Flynn’s participation in the call was discovered when he was reportedly unmasked.

He then turns to Gem #2 from the Epoch Times, which called a “nuclear bomb.”

As McCabe described the origin of the transcripts, “They came up—we found them through an effort—without getting into too long of an explanation—in an effort to respond to a tasking from [redacted] and so the results of what we found were communicated to the Agency, who I think had the pen on that response.”

“So, you got the call and you found the call based on a task you received from some redacted person nobody wants us to see,” Bongino noted, before whispering, “Who could that be?”

He then joked about Obama needing a mattifier to absorb a build up of sweat, before asking the very serious question: “Who has the power to order the FBI to go get that call?”

Citing the Foreign Intelligence Surveillance Act of 1978, Bongino proceeds to offer a possible answer:

Exception to Court Order Requirement: The President may authorize electronic surveillance to acquire foreign intelligence information for periods of up to one year without a FISC court order where the Attorney General certifies that there is “no substantial likelihood that the surveillance will acquire the contents of any communication to which a U.S. person is a party,” provided the surveillance is directed solely at communications among or between foreign powers, or “the acquisition of technical intelligence … from property or premises under the open and exclusive control of a foreign power.” 50 U.S.C. § 1802.

Bongino observed: “The President of the United States may authorize electronic surveillance to acquire foreign intelligence information for periods of up to one year without a FISA Court warrant. Oh, this is great, and who has to certify it? You read that right, the darn attorney general, Loretta Lynch!”

Of course, this led to the obvious follow-up.

“Was this an order by the attorney general… on the orders of Barack Obama himself?” Bongino asked, in reference to the FBI acquiring the call transcripts. “And he was just — Mike Flynn was just caught up in quote ‘incidental collection on a foreign power’?

He then concluded that there’s really no other explanation, asking: “Did Barack Obama order this?”
