Provisions of new gun control law in NY struck down by federal judge

On Thursday, a New York law restricting concealed-carry permits ran into a ruling by a federal judge who blocked enforcement of key parts of the law.

It’s nothing for gun rights activists to get excited about yet, as the decision will not go into effect for three days, during which time the state government will have a chance to appeal the ruling to a higher court.

The ruling by Chief Judge Glenn Suddaby of the Northern District of New York in Syracuse came as the result of a lawsuit filed by the Gun Owners of America (GOA) and the Gun Owners Foundation (GOF) on Sept 21. Judge Suddaby ruled that the plaintiffs have a legitimate case for a lawsuit against the law, large portions of which he determined were unconstitutional, The Washington Times reported.

The law, absurdly named The Concealed Carry Improvement Act, was passed on Sept 1. It requires that applicants for a permit complete 16 hours of classroom training and two hours of live-fire exercises. It also requires applicants to provide a list of social media accounts over the past three years as part of a “character and conduct” review and to re-certify their permits every three years.

Even more concerning for lawful gun owners, the law restricts permit holders from carrying in Times Square, parks, churches, theaters, and other “sensitive” places. Those who enter a private business can only carry with permission. Part of the plaintiffs’ argument is that the extensive list of prohibited spaces makes it hard to move around in public.

Clearly, NY legislators wanted to ban concealed carry permits altogether. This was the next best thing.

Upon passage of the law, New York’s unelected governor, Kathy Hochul, speechified.

“This whole concept that a good guy with a gun will stop the bad guys with a gun, it doesn’t hold up. And the data bears this out, so that theory is over.” An incredible statement. The data does not, in fact, bear out her contention, and she probably knows it.

The Washington Examiner’s Oct 4 piece reported: “In looking over FBI cases between 2014-2021, [John R. Lott, president of the Crime Prevention Research Center] found that some 34% were stopped by armed citizens (124 out of 360), not the 4% cited by the FBI and often used by the media to dismiss the importance of legally armed citizens.” So, just another reason to worry about the FBI – they are vastly undercounting the effectiveness of armed citizens against criminals.

Moreover, there is data showing that 57 percent of felons are actually more afraid of an armed citizen than a police officer.

There are some eye-opening facts about the 393 million guns owned by law-abiding citizens, according to a study commissioned by former President Barack Obama after the Sandy Hook Massacre. A highlight of the study showed that as many as 3 million crimes are thwarted annually by gun-carrying citizens, or about 8,200 every day.

None of this means anything to leftists. New York editor for POLITICO, Joseph Spector, who considers himself to be in a position to “keep New Yorkers safe,” was not pleased.

New York has been among the most aggressive states against guns. The more they pursue gun control laws, the more chaotic their streets become.

In 2013, the state passed the “Safe Act,” which was deemed “emergency legislation” and was passed in the middle of the night for your safety. This was the legislation that limited what kinds of guns you could have, and how many bullets could be in a magazine. Plus background checks for transfers. And the capstone – if someone questions your mental health, your gun can be taken from you.

Emergency legislation was passed for your safety. As if it weren’t already obvious that NY politicians don’t give a rip about your safety.

In 2020, to name just one case, a felon with previous convictions (attempted murder with a gun, carjacking, shooting at police, and a DUI) was out on parole and shot a police officer in the head. He shot another in the arm and proceeded to attack a police station. Because gun control laws don’t work. They never have. Their stated purpose is to keep us safe, but that can’t be their real purpose, because legislators know that criminals get guns illegally. It’s just the law-abiding people that have to go through all their ridiculous hoops.

The Babylon Bee has a video that depicts a California couple who moved to Texas, to be greeted by a neighbor who was open-carrying a handgun. This made the couple very uncomfortable, but the neighbor explained that everyone in Texas carries a gun. This seemed very unsafe to the California snowflakes, but the friendly man explained that they don’t have gun violence problems in their neighborhoods. Why not? they asked. “Because everyone carries a gun,” he replied with a smile.
