New video of drunk LSU sorority girl just before her death may play role in sentencing of alleged rapists

New footage has surfaced showing Louisiana State University student Madison Brooks drunkenly slurring her words, arguing, and apologizing to four men in the car where she was allegedly raped just minutes before she was hit and killed by another vehicle.

Brooks, an Alpha Phi sorority student, was only 19. She died shortly after she got out of the car, getting struck by a ride-share vehicle at 3 am in East Baton Rouge last month.

The impending rape trial of the four men she was with has been splashed across the headlines.

In the released video, Brooks can be heard slurring her words in the 29-second clip as she spoke with Kaivon Washington, 18. He is videoing himself and Brooks after an argument reportedly broke out. She appears to tell Desmond Carter, 17, to “get out” of the car so she can “Uber on her own” after apologizing for offending someone in the car. “I’m sorry that I offended you that bad,” she said before getting out.

The recording took place after Carter and Washington allegedly raped Brooks in the back of the car after they picked her up at Reggie’s bar in Tigerland, Louisiana, on January 15.

Carter has now had his charges upgraded by a grand jury and will stand trial as an adult facing a first-degree rape charge that could get him life in prison without the possibility of parole for the assault.

Washington is facing a third-degree rape charge. Prosecutors are hoping to upgrade his charges as well.

Casen Carver, 18, and Everett Lee, 28 were charged with being principal to third-degree rape for allegedly sitting in the front of the car while Brooks was sexually assaulted by Washington and Carter.

Defense attorney Ron Haley is claiming that although it is obvious Brooks was inebriated, she was capable of consent, according to the Daily Mail. Prosecutors are adamantly claiming that it is a clear case of rape. The judge also felt the video showed “criminality.”

Reggie’s bar has had its license revoked over the incident after Brooks was seen drunkenly stumbling out of the establishment. Other footage shows her running after the four men on the night she died.

Washington is a varsity football player who was accused of rape last October by another young woman after leaving Reggie’s. The girl claims she was too drunk to go home and asked if she could stay at one of Washington’s friend’s apartments, according to the Daily Mail.

The arrest affidavit claims that the victim started having sex with the friend in front of Washington. He pinned the girl down as she pleaded for him to “stop.” Washington at first watched, according to the affidavit, but then fondled her breast and vagina.

The Brooks rape is reportedly the third accusation of sexual assault against Washington. He was also accused of raping a 12-year-old girl in 2020 after following her home from a pool party when he was 15.

After Brooks was run over by the car, two good Samaritans stopped to perform CPR but it was too late. The East Baton Rouge Parish Coroner’s Office noted that she died from “multiple traumatic injuries.”

The driver of the car that hit the girl will not be charged since he was not impaired and contacted emergency services immediately.

Kerry Miller, the Louisiana attorney representing Brooks’ mother, Ashley Baustert, told Fox News Digital in an interview, “She was raped. Rape is rape. It’s just a horrific, terrible situation. And to the extent that those involved with the alleged rapist want to blame the victim and show up at press conferences and say things … we’re standing up for Madi. That’s not right. She was a victim of a horrific rape, which led to her death.”

“My beautiful angel, one and only daughter, and best friend that was taken way too soon. I promise to honor you, your legacy, and will do everything in my power to ensure no other family has to endure the pain we have faced,” Brooks’ mother wrote in a Facebook post.
