The former Marine who acted to protect his fellow subway passengers from a violent criminal with a long rap sheet will be charged by Manhattan District Attorney Alvin Bragg’s office for the accidental death of Jordan Neely who passed away after he was put into a chokehold.
Daniel Penny, who many have described as a hero for his intervention to subdue the disturbed Neely who snapped while onboard an F train in Lower Manhattan last week, will be charged with manslaughter by Bragg’s office on Friday and is expected to turn himself in.
“We can confirm that Daniel Penny will be arrested on a charge of Manslaughter in the Second Degree,” a spokesperson for Bragg’s office said on Thursday. “We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow.”
In the incident that tragically cut short Neely’s criminal career, the ex-Marine was aided by two other passengers in ending the threat from the mentally ill homeless man, a Michael Jackson impersonator who moonwalked his way to over 40 arrests at only 30 years old, including one for viciously attacking an elderly woman. But as has been the pattern in Bragg’s New York City, the lawless are a protected class.

Footage of the incident quickly went viral with angry mobs taking to the streets to protest the death of the left’s latest martyred black thug who has been portrayed as a victim of an oppressive white system, much as career criminal and drug addict George Floyd was three years ago after he perished at the hands of police while resisting arrest, setting off a national wave of violent riots.
In a Thursday statement, Penny’s attorneys said, “Once all the facts and circumstances surrounding this tragic incident are brought to bear, Mr. Penny will be fully absolved of any wrongdoing.”
“When Mr. Penny, a decorated Marine veteran, stepped in to protect himself and his fellow New Yorkers, his well-being was not assured. He risked his own life and safety, for the good of his fellow passengers,” said Steve Raiser of Raiser & Kenniff in the statement. “The unfortunate result was the unintended and unforeseen death of Mr. Neely.”
Bragg, one of the progressive prosecutors who has received backing from malevolent left-wing foreign billionaire George Soros, has been in the headlines for his political prosecution of former President Donald J. Trump who was arrested and released last month after a New York City grand jury brought forth a felony indictment of over 30 stacked charges centering around an alleged “hush money” payment to pornographic movie “actress” Stormy Daniels.
Like Trump, Penny’s case is one that is politically charged after the deceased thug’s death was latched onto by racial arsonists Rep. Alexandria Ocasio-Cortez (D-NY) and shakedown artist/Democrat power broker, the Reverend Al Sharpton, both of whom demanded that the USMC veteran be made to face severe retribution from the weaponized legal system.
“This man needs to be prosecuted cause what you will do if you do not prosecute him, in my judgment, is you will set a standard of vigilantism that we cannot tolerate,” Sharpton said at a rally last weekend. “The precedent alone is a threat to all of us. We cannot allow this lawlessness to go unchecked.”
Penny faces an uncertain fate if he is tried with an almost certain conviction by a New York City jury in his future and is the latest example of how in Democrat-controlled cities, acting to defend oneself and others from violent criminals is a ticket to years in prison.
