California becomes sanctuary state for those ‘charged with mutilating children,’ US Constitution be damned

Though many stayed up to celebrate the end of 2022 and the start of 2023, others saw the new year as an ominous beginning with a California law going into effect that threatens the health and welfare of children, protects criminals, and openly challenges the U.S. Constitution.

On September 29, 2022 California Gov. Gavin Newsom approved SB-107 after it had been introduced by openly gay state Sen. Scott Wiener of San Francisco in January 2021. The senator cheered on New Year’s Eve, “Tonight at midnight, SB 107 goes into effect & California officially becomes a state of refuge for trans kids & their families.”

But the Twitter account Techno Fog showcased the “darker” reality.

In a post accompanied by a screen shot of the legislation, Techno Fog quote tweeted Wiener and wrote, “The law is much darker than they let on. California is now a sanctuary state for those charged with mutilating children.”

The text highlighted in the image was from Sec. 9 that amended California Penal Code Section 819 to include, “California law enforcement agencies shall not knowingly make or participate in the arrest or participate in any extradition of an individual pursuant to an out-of-state arrest warrant for violation of another state’s law against providing, receiving, or allowing a child to receive gender-affirming health care and gender-affirming mental health care in this state, if that care is lawful under the laws of this state, to the fullest extent permitted by federal law.”

Many drew attention to the language of the Constitution which states in Article IV, Section 2, Clause 2 that “A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime.”

In other words, after committing a crime in Texas a person could not flee to California to be protected from the consequences of that act.

However, the bill aimed to override that clause and belittle the authority of the governing document as it specifically opens, “The United States Constitution generally requires a state to give full faith and credit to the public acts, records, and judicial proceedings of every other state. Existing law authorizes, upon the demand made by another state, the extradition of a person charged with committing an act in this state that results in a crime in the demanding state, as specified.”

This bill ignores that and Jeffrey Younger, a father from Texas who had previously challenged his ex-wife’s attempt to transition one of their twin sons in a custody battle, argued that the bill would protect her if she were to violate a district court order that “neither parent may treat a child with hormonal suppression therapy, puberty blockers, and/or transgender reassignment surgery (if any) without the consent of the parents or court order.”

Ahead of the law going into effect Younger sought an appeal with the Supreme Court of Texas to which he was denied.

Should the mother choose to proceed with “gender-affirming” care that would either chemically castrate the child or subject him to genital mutilation, she would be sheltered by the state of California and it appears as though barring expedited intercession from California or federal courts, there is nothing to be done to protect the child from irreversible harm.

Of note, Wiener is the same senator who introduced legislation to allow children as young as 12 to get vaccinated without parental consent and whose campaign was found to be one of those benefitting from donations given by the pharmaceutical company AbbVie which manufactures the chemical castration drug LuPron.
