A young mother is devastated after charges against a woman accused of punching her 1-year-old child in the face were dropped by a California judge because of not enough courtroom space and a shortage of judges.
“Take a look at the shocking surveillance video showing a California mother being attacked in a parking lot while holding her 1-year-old baby girl,” host Todd Piro directed “Fox & Friends First” viewers on Friday. “But get this, now a judge dropping the charges against a suspect over lack of courtroom space and a shortage of judges.”

Clarissa Guevara tearfully recounted the assault that took place, telling Piro that she lost a part of herself that day.
“As soon as I heard my daughter getting punched and a loud scream in my ear, that scream, that scream lives with me forever,” Guevara said through tears.
“She punched my daughter in the face,” Guevara said. “My one-year-old daughter…
“It scarred me and scarred my daughter. I don’t know how else to describe it. I’m just hurt that she’s getting away with this.”
The video shows a woman approach Guevara from behind and immediately begin throwing punches as Guevara holds her daughter in her arms.
“And I plead to her and asked her, let me put my child down at least,” Guevara said. “As you can see, she disregarded everything and just started throwing punches. My only thought was to protect my child and to make sure that she wasn’t getting hit whatsoever because if I knew I tried to put her down, she would try to kick her or run after her, you know?”
The assault, which Guevara says stemmed from an earlier domestic dispute, continued for several minutes, with her daughter struck in the face.
“She just kept going and going,” Guevara said remembering the violence and the trauma. “I’m just hurt that she’s getting away with this.”
According to Guevara, her attacker is “psychotic” and previously attacked two pregnant women.
California has dropped charges in more than 200 criminal cases, citing a backlog from the COVID-19 pandemic and a shortage of judges, according to reporting by Fox News, and Guevara is one of the many victims who will not see justice.
“The day that I went to the court was Halloween, to speak to the judge, to plead for him to not close the case,” Guevara said. “After me pleading to him, and in my statement I wrote, he ended up saying ‘there is not enough courtrooms and we are dismissing the case.’ As soon as I heard ‘dismiss,’ I couldn’t hold my tears back because — because my 1-year-old daughter ended up getting hurt by someone who is way older than her.”
The system left Guevara feeling like she was at fault.
“It is my job as a mother to make sure my daughter is protected,” she said openly crying. “And that was taken.”
Piro reassured Guevara that she had done nothing wrong in seeking justice, asserting that it was the system that had failed.
“Please, there is no need to apologize after what you went through. Every mother and parent would feel the same way,” the host said. “You did everything and stood up for your daughter and are still trying to stand up for your daughter. It is a messed up system that is preventing you from doing so. We can’t have this in a civilized society.”
With the alleged assailant free and knowing she will not face consequences, Guevara is afraid she will continue her assault.
“Knowing that she knows where my child lays her head at, knowing that she’s walking away free and bragging that she is not held responsible. That terrifies me as a mother for my child,” Guevara said.

Woke, liberal policies have prevented prosecutors from seeking justice in cases like Guevara’s, promoting an exodus of lawyers and judges from California’s justice system, exacerbating an already mounting problem, Piro said.

“You can’t tell me they are not enough courtrooms in Riverside County,” he lamented. “There has to be someone to put away the suspect who allegedly did this to your daughter! I’m ticked and I can imagine how upset you are as a mother.”
“My blood boils. It boils to the core knowing that she got away. And that she is bragging about she got away,” Guevara responded. “It terrifies me that they are dismissing so many cases for domestic violence. They are so many domestic violence cases that got dismissed. And it is just terrible.”
