Doctor who performed abortion on 10-yr-old rape victim signals intent to sue Indiana AG for defamation

Dr. Caitlin Bernard, the doctor who performed an abortion on a 10-year-old rape victim from Ohio, is signaling that she intends to sue Indiana Attorney General Todd Rokita after he opened an investigation into her actions.

The case is at the center of the abortion firestorm after the child allegedly was forced to cross state lines to get an abortion following Ohio implementing new restrictive laws following the overturning of Roe vs. Wade.

The doctor’s legal representative Kathleen DeLaney sent a letter to Rokita informing him that Bernard will seek compensation for damages pertaining to “security costs, legal fees, reputational harm, and emotional distress.”

“Rokita’s false and misleading statements about alleged misconduct by Dr. Bernard in her profession constitute defamation per se. The statements have been and continue to be published by or on behalf of Mr. Rokita and the Office of the Attorney General. To the extent that these statements exceed the general scope of Mr. Rokita’s authority as Indiana’s Attorney General, the statement forms the basis of an actionable defamation claim against Mr. Rokita individually,” the letter states.

“Mr. Rokita recklessly and/or negligently failed to ascertain whether the statements about Dr. Bernard’s licensure were true or false before making them. Statements that Dr. Bernard has a ‘history of failing to report,’ which Mr. Rokita indicated would constitute a crime, made in the absence of reasonable investigation, serve no legitimate law enforcement purpose. Given the current political atmosphere in the United States, Mr. Rokita’s comments were intended to heighten public condemnation of Dr. Bernard, who legally provided legitimate medical care,” the letter added.

“He is wrongly accusing her of misconduct in her profession, so we want that smear campaign to stop,” DeLaney said in an interview with NPR on Tuesday. “We want him and his office to stop intimidating and harassing healthcare providers generally who are simply doing the job that they went to medical school to do.”

The child was raped and impregnated by an illegal alien. The story was first reported by the Indianapolis Star.

Due to a lack of facts and evidence at the time of the abortion, many cast doubt on the story due to the young age of the victim and the politicization of the procedure. Eventually, it was reported that a 27-year-old illegal alien from Guatemala named Gerson Fuentes was the predator that raped the girl at least twice. He confessed to the heinous crime.

Bernard is using Rokita’s appearance on the Fox News show “Jesse Watters Primetime” where he accused her of failing to report the rape as the basis for legal action. It is now being said that she did, in fact, report the procedure and the rape before the deadline, according to The Washington Post and other media outlets.

“We have this abortion activist acting as a doctor with a history of failing to report,” Rokita charged. “We’re gathering the evidence as we speak, and we’re going to fight this to the end, including looking at her licensure. If she failed to report it in Indiana, it’s a crime for — to not report, to intentionally not report.”

Following that appearance, Rokita announced his investigation into Bernard’s purported failure to report a crime in a timely manner. The doctor could possibly face criminal prosecution and loss of her medical license pending the findings of the investigation.

A spokesperson for Rokita stated that Bernard’s claim is “baseless” and attempts to “distract from the important work of the office,” according to the Associated Press.

“Attorney General Rokita and the Office of Attorney General are leaders in the pro-life movement,” spokesperson Kelly Stevenson said in an email to the AP. “His historic work has further distinguished Indiana as a protector of unborn life and women.”
