Supreme Court expected to expand gun rights as Biden, Trudeau drop the hammer on handguns

With President Joe Biden making noise about banning 9mm handguns, and Canadian Prime Minister Justin Trudeau introducing legislation to freeze handgun sales, the Supreme Court is about to issue a major Second Amendment opinion—its first in over a decade.

All this comes amid a spate of horrific mass shootings that has caused the gun control debate to flare up at a time when the country’s divisions have never been greater.

The Supreme Court’s conservative majority will be ruling on the constitutionality of certain limits placed by New York state on the concealed carry rights of state residents, and it is likely they will invalidate the restrictions.

“It does seem relatively clear that the court is going to strike down New York’s law and make it harder for cities and states to restrict concealed carry of firearms,” Adam Winkler, a professor at UCLA School of Law, told The Hill.

“It remains to be seen exactly how broad the Supreme Court goes, but one thing is clear: as mass shootings become more of a political issue, the court is going to take options away from lawmakers on the basis of the Second Amendment.”

The ruling from the justices could come as early as next week—but will certainly be no later than early July. However the justices rule, it will likely add fuel to an already tense debate that shows no signs of abating anytime soon.

Amid the terrible mass shootings that seem to be a weekly occurrence, Democratic politicians have escalated their talk of gun restrictions and legislation that encroaches ever further on the rights of law-abiding gun owners.

On Monday, for instance, Biden set his sights on 9 mm handguns—not the high-powered rifles actually used in the recent mass shootings—by repeating outlandish claims about what they can do.

“A 9 mm bullet blows the lung out of the body,” he said. “So the idea of these high-caliber weapons—there’s simply no rational basis for it in terms of self-protection, hunting.”

Meanwhile, our neighbors to the north have enacted a sweeping freeze on the sale and transfer of any handguns.

In a press conference on Monday, Canadian Prime Minister Justin Trudeau essentially halted all sales and transfers of firearms.

“What this means is that it will no longer be possible to buy, sell, transfer or import handguns anywhere in Canada,” he said. “We recognize that the vast majority of gun owners use them safely and in accordance with the law, but other than using firearms for sport shooting and hunting, there is no reason anyone in Canada should need guns in their everyday lives.”

Pointedly, the prime minister neglected to mention the right of every human being to the means of self-defense—something once recognized in Canada as well as in the United States.

The upcoming Supreme Court ruling will be the first Second Amendment ruling by the Court since 2008’s District of Columbia v. Heller. In that case, the Court ruled that Second Amendment covers a citizen’s right to maintain a gun in the home for the purpose of self-defense. The Supreme Court’s decision in the New York case may define what restrictions the government can impose on the right to bear arms.

  1. 9mm and 380 and 38 are not “high caliber”. Think 45,50,308, 30-06 and 12ga. Your ignorance of firearms is huge. What would “blow the lungs our” are the type of bullet. Like soft nose expanding type. Dum Dums Not steel nose military.

  2. Isn’t stopping power the “rational” for the 9MM? Will he then go onto seek band on 10mm, 40mm, 45 and others? Yeah – that’s their goal.

  3. “exactly how broad the Supreme Court goes”. How about as broad as the simple language contained within the 2nd Amendment “…shall not be abridged..”? That’s pretty plain language right there. As for “A 9 mm bullet blows the lung out of the body,”; no, a 9mm won’t even REACH the lung of an excessively obese person or someone wearing heavy clothing which is why I carry a .45 with a full mag of RIP rounds. THAT will “blow a lung out of the body.”!!

    3. I see Canada headed for the tyranny that our founding fathers foresaw when crafting the 2nd amendment to our constitution. Mexico already had it (tyranny) but the cartels ruined everything and some communities have now organized vigilante gangs armed to resist both cartels and corrupt government. Don’t try to carry a gun into Mexico but be sure to buy one when you get there.

  6. A 9mm round is not very effective as a self defense round, better than nothing but not the choice for many. I use 45.ACP and .44 special rounds because of their mass and stopping power at close range. When you carry a concealed weapon for self protection, if you need to use it, you are probably not going to get in a prolonged firefight and it will be at close range. You need a round that will put down the threat immediately. I would not want to depend on a 9mm round for that job.

    1. Agree with your rationale but appreciate the lighter 9mm for concealed carry. Carrying a concealed 45 requires a whole new wardrobe. If you can put three rounds in three targets from fifteen feet in less than ten seconds the 9mm will probably be more than enough to disrupt the situation. You can always give them all a head shot to close out the engagement.

  7. The Supreme Court has no say, the matter was made clear, settled by our founding fathers!
    The 2nd Amendment is clear and concise, more so than any Amendment, in that it deliberately does not specify any governmental entity at any level, it merely states, “shall not be infringed”!
    Think about mindset and the logic, which our founding fathers possessed in a far greater capacity than the politicians today, in creating the Amendment, of what use is an Amendment that forbids the fed, yet allows states, counties and or cities to infringe?
    Such would defeat the whole purpose!
    Is religion to be regulated by state, can counties search without a warrant, can a city force one to testify against oneself?
    Why is it that the ONLY Amendment that most clearly, absolutely states, “shall NOT be infringed”, is the very Amendment that has been infringed upon by EVERY governmental body at every level?
    Logic also dictates that all related items will NOT be infringed, meaning magazines and ammo as it was NOT created to protect hunting, sport shooting, nor even self-defense, from any other than our own government!
    There is no debate to be had, the 2nd Amendment was clearly intended to be absolute, and we are now witnessing the rationale for same, as a global, tyrannical rule is obviously the intent of this administration of usurpers!

    1. The Supreme Court should declare Constitutional Carry in every state. All gun control laws about guns are already an infringement on what the Constitution has granted the citizens. States like NY and CA are overstepping what the Constitution ensures us for protection. Stop trying to treat the citizens as potential criminals.
