Republicans celebrate end of travel mask mandate as White House and leftists fume: ‘Our system is badly broken’

Freedom-loving Americans celebrated on Monday after a Florida federal judge struck down President Joe Biden’s transportation mask mandate in another blow to the White House and its authoritarian response to the COVID pandemic, the second major court defeat this year.

In a stinging rebuke to the Biden administration’s overreach, U.S. District Judge Kathryn Kimball Mizelle ruled in Tampa that the mandate by the U.S. Centers for Disease Control and Prevention (CDC) that applied to airlines and other public transportation exceeded the agency’s authority, ruling in favor of the Health Freedom Defense Fund, a group that sued the regime over the order that has been set to expire several times.

In a 59-page ruling, Judge Mizelle, who was appointed by former President Donald J. Trump wrote, “Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate.”

Her smackdown of the CDC comes after public health bureaucrats once again moved the goalposts by extending the controversial mandate last week. It is huge another setback for Biden whose employer vaccine mandate was shot down in flames by the Supreme Court in January.

Florida Governor Ron DeSantis whose leadership on COVID has been the gold standard hailed the ruling.

“Great to see a federal judge in Florida follow the law and reject the Biden transportation mask mandate. Both airline employees and passengers deserve to have this misery end,” the Sunshine State Republican tweeted.

Others reacted to the ruling.

“If you’re an anti-science loser who wants to wear a mask on an airplane for the rest of your life, you can do that. But the rest of us are long since ready for idiocy to end,” wrote Clay Travis of Outkick.com and the nationally syndicated Clay & Buck Show.

“Great news—a federal judge struck down Biden’s stupid transportation mask mandate, “wrote Republican Senator Tom Cotton. “This is a win for common sense and a crushing loss for the Democrats’ obsession with forcing Americans to wear masks forever.”

GOP Rep. Lee Zeldin of New York wrote, “Great news! The Biden Admin’s unscientific travel mask mandate has been STRUCK DOWN by a federal judge! This is the correct & long overdue decision. Americans are ready for a return to normalcy & it’s time for @JoeBiden & control freak bureaucrats to stop standing in their way.”

More reactions to the good news.

Not everyone was happy, especially the White House which could fight back with Justice Department litigation, a possibility left open by outgoing White House press secretary Jen Psaki.

“The CDC recommended continuing the order for additional time – two weeks – to be able to assess the latest science in keeping with its responsibility to protect the American people,” Psaki said.

She added, “So this is obviously a disappointing decision, the CDC continues recommending wearing a mask in public transit, as you know this just came out this afternoon so right now the Department of Homeland Security who would be implementing and the CDC are reviewing the decision and of course, the Department of Justice would make any determinations about litigation.”

Leftist COVID cultists also melted down as their false perception of moral superiority continues to slip through their grasp.

Another possibility is that the administration may not choose the mask mandate as the hill to die on, while a battle over transportation masking would greatly please the dead-enders, it could sway even more voters to toss the party out of power in the midterms.

  1. Hey Jen, just a quick question? How many times has the mask mandate been extended? How many years of study does the CDC need before it figures out that masks on public transportation are a Fauci farce? Second question, who provides masks to all the illegals the Biden regime is sticking on planes, trains and busses, while shipping them all over the country, except DC and of course Delaware?

  2. The CDC can recommend at it wants. Mandating anything is not within their charter.

  5. What about city busses? It’s still mandatory to wear a mask on a city bus where I live. That’s public transportation shouldn’t that count as well?

  7. Those that are so upset are because they see their CONTROL evaporating! Wait for their next crisis, but refuse to participate in it. If they trot Fauci or Walensky out again, remember FAUCI lied to us and WALENSKY seems to check with the teachers’ union and makes the decision they want. Thanks to them, I have absolutely no faith left in any of the gov’t health agencies, and feel new leadership is needed. IMO, Fauci even broke the law, by going around to the NIH to get money to China for the GAIN OF FUNCTION studies, which had been outlawed, and the result of his actions, used our money to pay for the virus, that has cost many their lives, especially the elderly, obese, and those with compromised health.

    We have a three system government: executive (carry’s out laws), legislative (makes laws), and judicial (evaluates laws).

    Given that simple understanding, NO, the Courts are NOT effectively taking away power from the federal government. In fact, the court in this case is exercising its constitutional obligation.
