Dershowitz: ‘I haven’t seen anything that points directly to Hillary Clinton’ in Durham probe

Alan Dershowitz and Hugh Hewitt both pump brakes on Clinton coverage: ‘The media has made too much of this filing’

Attorney Alan Dershowitz and conservative radio host Hugh Hewitt both attempted to tamper down the frenzy in conservative media over Special Counsel John Durham’s latest filing concerning Russiagate and former Secretary of State Hillary Clinton’s involvement in it.

“Well, as usual, it’s split down the middle,” Dershowitz told NewsMax host Sean Spicer who asked what was actually going on with the Durham filing on Thursday. “It is a big deal and it constitutes probable cause for believing that people in the Clinton campaign were certainly involved in dirty politics. Whether they crossed the line to criminality – let’s not rush to judgment.”

His comment is in reference to a filing by Durham concerning former Hillary Clinton campaign attorney Michael Sussman and his access to internet data from servers in Trump Tower and the White House in 2016 and 2017. Sussman has been indicted for making a false statement to the FBI.

Sussmann is alleged to have given the FBI information attempting to tie former President Donald Trump to Russia. While doing so, he said he was not working on behalf of “any client,” according to the motion. Durham notes Sussmann was billing the Clinton campaign at the time.

Dershowitz pointed out that the report has not been released yet and asserted that the indictments that the probe has produced so far are “process crimes” instead of “substantive indictments.” He predicted the investigation would reveal “very, very dirty politics” that were conducted by some people on Clinton’s campaign. He also said he was a friend of Clinton and he was very “disappointed” in her, but added, “I haven’t seen anything that points directly to Hillary Clinton.”

“Special Report” host Bret Baier asked Hewitt to weigh in on the explosive story, stating that Clinton had “laughed off” the Durham filing in a speech earlier in the day.

Hewitt responded, “Well, I agree that the media has made too much of this filing. I think I said two nights ago we don’t know anything yet because Sussmann can go John Dean or go Gordon Liddy. I know John Durham said there will be motions in limine coming. And, Harold, I know we did go to Michigan Law School and we both know one thing from our time there from great law professors, nobody knows nothing about what the prosecution has until the prosecution rolls out its indictment.”

The New York Times is contending that little in Durham’s motion is new: “When John H. Durham, the Trump-era special counsel investigating the inquiry into Russia’s 2016 election interference, filed a pretrial motion on Friday night, he slipped in a few extra sentences that set off a furor among right-wing outlets about purported spying on former President Donald J. Trump.”

“But the entire narrative appeared to be mostly wrong or old news — the latest example of the challenge created by a barrage of similar conspiracy theories from Mr. Trump and his allies,” the leftist media outlet concluded.

Speaking at the New York State Democratic Convention on Thursday, Clinton clapped back at Fox News and hinted at a lawsuit.

“Fox leads the charge with accusations against me, counting on their audience to fall for it again,” Clinton charged. “And as an aside, they’re getting awfully close to actual malice in their attacks.”

Clinton also attacked Fox News and Trump on Twitter earlier in an effort to deflect from the Durham investigation.
