Cheney accused of lying to witnesses in Jan 6 probe: ‘If this was a real investigation, that’d land you in jail’

Is the U.S. House committee that purports to be investigating the January 6 riot at the Capitol even more of a kangaroo court than many in the MAGA contingent already believe it is?

According to tireless journalist Mollie Hemingway who is an astute observer of Democrat machinations, the “uni-party” committee may be violating somewhat arcane but important House procedures when it interviews or deposes witnesses, a process which requires a majority and minority staff participation.

Reacting to this scenario, U.S. Rep. Jim Banks (R-Ind.) wrote on Twitter that “The sham Select Committee is lying to witnesses before they testify under oath. This is dangerous.”

“January 6 Select Committee staff have been falsely telling witnesses that Republican staff will be present for interviews, according to multiple eyewitness sources and documents. In fact, not a single Republican-appointed member of Congress nor a single staff member representing the Republican conference is part of the controversial committee,” Hemingway explained in The Federalist.

“The point of these rules is to structure depositions so the minority and the majority counsel have the same opportunity to question witnesses and gather information for their separate reports.”

In July, House Speaker Nancy Pelosi (D-Calif.) de-selected Rep. Banks and Jim Jordan (R-Ohio) from the select committee, which prompted House Minority Leader Kevin McCarthy to pull official GOP participation from the panel.

Pelosi then appointed compliant Never Trumpers Liz Cheney (R-Wyo.) and Adam Kinzinger (R-Ill.) instead.

The off-the-rails Cheney, who had already been ousted from the GOP leadership, subsequently was named vice-chair to give the J6 committee a veneer of bipartisanship.

“Witnesses are being told that John Wood, a longtime friend and ally of the Cheney family, will represent Republicans when witnesses testify. But neither Cheney nor her friend is representing the Republican conference,” Hemingway added.

“The rules do not envision the circumstances that accompany Pelosi’s uni-party select committee. The House Rules ‘become nonsensical in a situation like this,’ said one congressional aide, adding, ‘This isn’t just a partisan investigation — it’s a coverup.'”

Hemingway highlighted the incongruity of neocon Liz Cheney somehow operating as “the ranking member for the minority party while also being the vice-chair for the majority party.”

“[C]ommittee rules require consultation with the ranking member before taking certain basic actions, such as taking depositions, including those pursuant to subpoenas. ‘So how can you consult with the ranking member when you don’t have one?’ asked one Hill attorney.”

Rep. Banks has implied that the whole thing is just sham political theater, Hemingway noted:

Liz Cheney ran to CNN a few weeks ago to accuse conservative stalwart Rep. Jim Banks of falsely presenting himself as the Jan. 6 commission’s ranking member. Banks is, in fact, congressional Republicans’ choice to be their top investigator on the committee, but he has been prevented from fulfilling his duties by Speaker of the House Nancy Pelosi. However, it’s Cheney who appears to be misrepresenting herself as the ranking member — that is, the top Republican — on the committee…

“John Wood works for the Democrat Party, just like Liz Cheney, who was appointed by Pelosi and is not the Ranking Member of the Select Committee. She is misleading witnesses, before they testify under penalty of law, about the motives and the position of the person questioning them,” said Banks, who has continued leading Republicans’ investigation of the federal government’s handling of the Jan. 6 riot at the Capitol…

Cheney was given six days to explain whether she considers herself just the Democrat-appointed vice-chair of the committee or also the Republican ranking member, as is being represented to key witnesses. She has not responded to multiple requests for comment.

“If this was a real investigation, that’d land you in jail for prosecutorial misconduct,” Banks said of the false representation. “Fortunately for Liz, this is a sham investigation,” he added.

Common sense suggests perhaps that the committee will issue a report around the time of the 2022 midterms that blames ex-President Donald Trump for the chaos at the Capitol.

It’s also very likely that during the proceedings, neither Cheney nor Kinzinger (the latter who is not seeking reelection and the former will probably be defeated in the primary) will pose some key questions about the incident that have been raised, for example, by Fox News host Tucker Carlson.

Among them, why did the House sergeant-at-arms, a Pelosi subordinate, allegedly deny the Capitol police chief’s repeated requests for National Guard backup when everyone knew a huge protest was coming.

And what role, if any, did FBI informants or operatives play on January 6?
