Congress and staff are exempt from Biden’s heavy-handed COVID-19 federal vaccine mandate

Congress is not subject to President Joe Biden’s draconian vaccine mandate that applies to all federal workers and contractors, forcing them to get the COVID-19 vaccination whether they want to or not.

Biden’s mandate announced last week eliminates the option for getting regular testing and instead orders federal employees and contractors to immediately get vaccinated or allegedly lose their jobs. Some religious and disability exemptions are being allowed but those are now in doubt as well.

But the White House confirmed to Fox News that the president’s two executive orders do not apply to Congress, staffers, or the federal court system.

The President’s executive orders only apply to the executive branch. Those who work under the legislative and judicial branches of the federal government are not included.

Biden also announced that companies with 100 or more employees must require them to either be vaccinated or submit to weekly testing under a forthcoming emergency order by the Labor Department’s Occupational Safety and Health Administration (OSHA). That order will apply to more than 80 million workers. Violations of that edict will result in a fine of nearly $14,000 per incident.

It should be noted that OSHA has never mandated vaccines and many see this as a workaround to skirt the Constitution, weaponizing the agency.

In one executive order that Biden signed last Thursday, he wrote: “It is the policy of my Administration to halt the spread of coronavirus disease 2019 (COVID-19), including the B.1.617.2 (Delta) variant, by relying on the best available data and science-based public health measures.”

It added, “The Centers for Disease Control and Prevention (CDC) within the Department of Health and Human Services has determined that the best way to slow the spread of COVID-19 and to prevent infection by the Delta variant or other variants is to be vaccinated.”

The order contended that for the health and safety of the federal workforce and the efficiency of the civil service, “it is necessary to require COVID-19 vaccination for all Federal employees, subject to such exceptions as required by law.”

In another executive order signed on the same day, Biden wrote: “My message to unvaccinated Americans is this, what more is there to wait for? What more do you need to see? We’ve made vaccinations free, safe and convenient. The vaccine is FDA-approved. Over 200 million Americans have gotten at least one shot. We’ve been patient, but our patience is wearing thin.”

He announced “… The Department of Labor is developing an emergency rule to require all employers with 100 or more employees, that together employ over 80 million workers, to ensure their workforces are fully vaccinated or show a negative test at least once a week.”

House Speaker Nancy Pelosi announced in April that Congress could not mandate members to get the vaccine and that it was a “matter of privacy.”

“We cannot require someone to be vaccinated. It’s just not what we can do,” Pelosi asserted, according to Forbes.

She claimed in August that she would be open to mandating the vaccine after it receives full FDA approval. She has not addressed the issue since Pfizer’s vaccine received approval later in August.
