An MSNBC panel engaged in some over-the-top histrionics while bitterly lamenting the new Texas law that, according to the left, could signal the end of Roe v. Wade, the landmark 1973 U.S. Supreme Court decision that legalized abortion throughout the country.
Signed by Gov. Greg Abbott in May, the law bans abortions in Texas upon detection of a fetal heartbeat, which can occur as early as six weeks.
Solutions-oriented panelist Elie Mystal, a “justice correspondent” for the far-left Nation magazine, called for the Biden administration to “go buck wild” and, among other things, more or less deploy into Texas physicians willing to perform abortions during the conversation embedded below in two parts, of which you can review in its entirety and draw your own conclusions.
The outraged journalist and Harvard Law School graduate also slammed the Biden administration for being asleep at the switch, as it were, in the intervening months. “What do you mean, you’re looking into it now?”
A split Supreme Court has allowed the law to go into effect, at least for the time being, but further litigation is likely, if not guaranteed.
Anchor Tiffany Cross, who was also joined in the discussion by the president/CEO of Whole Woman’s Health, the organization that is the lead plaintiff in the case, set the table with some worn-out tropes.
This included making comparisons to the dystopian novel and TV show “The Handmaid’s Tale” and its totalitarian fictional location of Gilead along with accusing those she politically disagrees with as equivalent to the Taliban. (MSNBC colleague Joy Reid has also used the latter talking point.)
Cross also smeared — without evidence — Justice Amy Coney Barrett as “an actual ‘handmaid’ on the court.”
“If they cared about life, they would be giving women $10,000 and free health care to bring pregnancies to term, not giving people $10,000 to go rat them out to the state,” an amped-up Mystal responded as part of his diatribe.
“It’s nothing to do with life. It’s everything to do with the control of women’s bodies, but that’s what the Supreme Court, five of those justices, that’s what they’re down for. Do not sugar coat this. It’s not that the Supreme Court couldn’t figure out how to rule. No. What the Supreme Court did was take 50 years of precedent that was Roe v. Wade, and take 30 years of precedent that was Planned Parenthood V Casey, and throw it out the window.
“That’s where we are now. Roe is dead…”
“One option would be for Biden to federalize doctors, to hire a federal force of doctors, send them into Texas to protect people’s constitutional rights,” he continued.
“Because the Texas law is only enforceable through private civil action, federal employees are protected from private civil lawsuits through the doctrine of qualified immunity, which most of the time I hate…,”Mystal asserted about the administration’s possible “willingness to get its hands dirty.”
“There’s also federal enclave law. That would allow military bases to basically perform medical services without being sued by, again, private citizens.” Another one of his potential solutions is to make abortions free of charge.
He acknowledged, however, that some of these proposals could run afoul of the Hyde Amendment, that bans the use of federal funds to pay for abortions.
Court-packing fan Mystal also warned that the entire “former confederacy” would pass similar laws to put undermine Roe, “adding that laws targeting the KKK could theoretically be used “against private citizens who are ‘Klaning’ themselves up only this time to stop women from accessing their constitutional rights.”
In a perhaps disturbing mixed metaphor, Mystal claimed that Roe was “on life support” as soon as the late Justice Ruth Bader Ginsburg passed away.
During the conversation, Cross chimed in about “dangerous white men” being in power, perhaps forgetting that Joe Biden is president.

As alluded to above, the law gives a cause of action to private parties against abortion providers or anyone who facilitates same.
As such, Democrats from President Joe Biden on down, including the MSNBC panelists, have seized upon another hyperbolic talking point, i.e., that the legislation is equivalent to vigilante justice. That’s an interesting premise in that the Democrats are closely aligned with the lucrative trial lawyer industry industrial complex.
Under the principle of federalism, states are empowered to pass a host of laws that differ from those enacted in other jurisdictions. Prominent George Washington University law professor Jonathan Turley, a self-described liberal, has pointed out that Joe Biden hasn’t been exactly pro-choice when it comes to states’ rights.
“There are obvious limits to the pro-choice values of the Biden administration: They clearly do not extend to state autonomy or authority. When it comes to the right to choose on key policies — from elections to unions to taxes to climate change to abortion — states would have fewer and fewer choices to make,” he wrote.
Turley separately chided the media for its apocalyptic, distorted coverage of the Texas law, even though there are legitimate concerns about the future of the Roe decision.
Legal analysts once prized our role of transcending the political rhetoric and offering detached and honest appraisals of legal decisions and developments. However, in the age of echo journalism, legal experts are expected to drive ratings and readership with breathless, partisan takes on every story. Some of that analysis constitutes raw conspiracies theories dressed up as legal analysis like declaring that this order proves the “very real possibility in America right now that the federal courts are conspiring against us, against the rights of women, of people of color, of voters, of poor people.” Others cut to the chase and demanded that Congress immediately pack the Supreme Court with a liberal majority to guarantee results in such cases.
The professor also noted that a major abortion case is already on the high court’s docket that could have far-reaching implications.
Cross ended the segment by claiming that a majority of Americans support legal and safe abortions. Given the complexity of human relationships, many Americans apart from the pro-life or pro-life camp are conflicted about the issue. The unseemly Democrat/media obsession with abortion is another matter.
A Texas state judge has temporarily put the law on hold at it relates to the Texas Right to Life organization, but the effectiveness of the ruling remains to be seen, as well as whether it will be overruled.
