Texas sheriff accuses Biden admin of ‘full nullification of the law’ over executive actions on immigration

A Texas sheriff shredded President Joe Biden over a series of executive orders undoing his predecessor’s tough immigration enforcement directives, saying that the current administration is essentially “defunding” the Immigration and Customs Enforcement agency “by memo.”

“The memo that I received this last week — it’s a defunding-ICE-by-memo — memorandum, sent out January 20, 2021,” Jackson County Sheriff A. J. Louderback told Fox News’ Tucker Carlson Tuesday evening.

“This is a particularly devastating document for Texans and Americans here in the United States,” he continued. “When I read it and looked at it, it’s a message to the world that you can come here illegally, you can commit crimes here against Americans, and remain illegally.”

Louderback, who said that the memo was sent by then-acting Homeland Security chief David Pekoske, went on to suggest that Biden’s lax immigration and border enforcement policies are similar to those enacted under former President Barack Obama, when Biden was vice president.

“We walked this path from 2008 to 2016,” Louderback told Carlson. “This program that was released by memorandum is very similar to the Priority Enforcement Program in 2014 and 2015, where people were able to commit crimes against Americans.

“The COVID issue [is being] overlooked during that time. So, I struggle for a thought process, like many Americans and Texans, on how an administration can conduct themselves in this matter,” he added.

Regarding the pandemic, Carlson reported on his program Monday that under Biden’s executive orders, illegal immigrants are being released into the country’s interior without knowing if they are positive for COVID-19, even as everyone entering the U.S., including Americans, are required to have an existing negative test.

Carlson cited Brandon Judd, president of the National Border Patrol Council, whom he said told the program, “We do not test the illegal aliens we release. So we’re releasing people without knowing, which obviously puts the public at risk.”

“This isn’t a policy, it’s an act of aggression. It’s designed to humiliate you and demoralize you,” Carlson said. “Reckless and destructive immigration policy is the penalty you are paying for your white supremacy. It’s almost too dark to believe that’s their motive, but it is.”

Louderback made a similar observation, accusing the president of “promoting a lawless attitude” that will result in Americans being hurt or killed.

“Every peace officer in the United States should be extremely concerned about the attitude, the lawlessness, the complete abject removal of law,” the sheriff said. “We have a full nullification of the law going on here. We’re going to allow our ICE officers, USCIS, all affected by this memo, which guts the INA and handcuffs them so that they’re unable to respond.

“So in law enforcement here, those of us that don’t have the jurisdiction to enforce the federal laws here, we’ve created a situation that is unthinkable for the public,” Louderback said.

Since taking office last month, Biden has signed dozens of executive orders, many aimed at undoing or reversing former President Donald Trump’s tough approach to border and immigration enforcement.

They include changes in enforcement policy that deemphasize the deportation of illegal aliens convicted of DUIs, assault, drug crimes, sex-related crimes, and others.

Asked about the changes earlier this week, White House spokeswoman Jen Psaki suggested that local law enforcers would have to deal with those crimes.

“Nobody is saying that DUIs or assault are acceptable behavior and those arrested for such activities should be tried and sentenced as appropriate by local law enforcement,” Psaki said. “But we’re talking about the prioritization of who is going to be deported from the country.”
