Why ‘Biden Rule’ doesn’t apply: Libs terrified Senate will replace Ginsburg if SCOTUS seat opens in 2020

The Left is petrified about the near-term prospect that Senate Republicans would quickly replace Supreme Court Justice Ruth Bader Ginsburg should her seat became vacant in 2020 following her string of health problems.

Specifically, Democrats are terrified that Republicans will fill the Supreme Court with a conservative judge during an election year, which is a rare occurrence.

Leftist Twitter users fumed that they have no doubt that Senate Majority Leader Mitch McConnell would replace Ginsburg in a second if her seat opened up.

One person sarcastically quipped: “If RBG croaked just after midnight on January 20, 2021, Judge [Jeanine] Pirro would be taking her seat by sunrise.”

The tweet suggests that even this left-wing Twitter user believes it’s a foregone conclusion that Trump will win re-election.

Keep in mind that the Democrats launched a sham impeachment against President Trump right after their prior Russia collusion hoax collapsed. So the sanctimonious Left is not exactly in a position to lecture anyone about respecting precedent or political ethics.

Democrats are still furious that the Republican-led Senate refused to vote on district Judge Merrick Garland’s nomination to the U.S. Supreme Court in 2016.

At the time, Republicans cited a 1992 speech by then-senator Joe Biden, where he urged then-President Bush to wait until after the election to replace a Supreme Court seat if it became vacant during that election year.

GOP strategist Ed Whelan reacted to the latest left-wing meltdown by saying that’s the “Biden Rule,” and it only applies when the president and the Senate majority are of opposite parties. That’s not the case here, since both Trump and the Senate majority are Republican.

Whelan retorted: “Funny how Left (1) concocts claim that Biden rule applies in election years when president and Senate are of *same* party, and (2) forgets its own 2016 argument…that Senate is constitutionally obligated to hold an up-or-down vote on a SCOTUS nominee.”

At this point, the gloves are (or should be) off, since the Democratic Party is trying to undo the results of a nationwide election with their failing impeachment stunt.

If the situation were reversed and there was a Democratic president and Senate majority, there’s little doubt that Democrats would immediately fill the Supreme Court with a liberal judge if the seat became vacant during an election year.

The Democrats have made no secret of their desire to pack the courts with left-wing activist judges. The naked power grab has become so transparent that even Justice Ruth Bader Ginsburg — a liberal — slammed the idea.

In a stunning turn of events, Ginsburg scolded Democrats in July 2019 for trying to pack the U.S. Supreme Court with left-wing activist judges.

RBG made the surprise assertions during an interview with NPR, where she was asked about the promises that Democratic presidential candidates have made about packing the Supreme Court with activist left-wing judges.

The Democratic candidates also want to increase the number of Supreme Court justices, but Ginsburg said nine is a good number.

“If anything would make the Court appear partisan, it would be that,” Ginsburg said. “One side saying, ‘When we’re in power we’re going to enlarge the number of judges so we want to have more people who vote the way we want them to.’ I am not at all in favor of that solution.”

Ruth Bader Ginsburg — a noted anti-Trumper — delivered another knockout blow to Democrats when she praised fellow Supreme Court Justices Brett Kavanaugh and Neil Gorsuch as good men and great jurists.

“My two newest colleagues are very decent, very smart individuals,” Ginsburg said in July 2019.

Before conservatives hail RBG as a hero, they should keep in mind that Ginsburg, 86, refuses to retire and says wants to stay on the bench until she’s 90. Not because she loves her job, but because she apparently wants to spite President Trump.

Ginsburg was appointed in 1994 by Bill Clinton. Ginsburg previously suggested that she would have retired in 2018 if Hillary Clinton had won the presidency.
