The attorney for “ISIS bride” Hoda Muthana insists that the jihadi terrorist has the right to return to the United States from Syria even though President Trump denied her request.
This week, a judge denied Muthana’s motion to fast-track her case in order to expedite her return.
Muthana’s Lawyer: ISIS Recruit Has Right to Return
Her lawyer, Charles Swift, told Fox News host Martha MacCallum that Hoda has the right to come back to the US even though she basically committed treason by joining ISIS.
“We were disappointed, but not terribly surprised [by the judge’s decision]. To prevail, we had to show she would suffer immediate harm. That was a difficult question.
Although we were disappointed on that part of the ruling, we were encouraged by the judge’s comments on the strength of our case. He did not rule that our case was not strong.”
The government’s argument is that she is not a citizen — not because she wasn’t born here — and not because her father was a diplomat at the time.”
ISIS Recruits Women To Breed Terrorist Army
As BizPac Review reported, Muthana was a naturalized US citizen who was born in New Jersey to a Yemeni diplomat.
Children born in the United States to foreign diplomats do not automatically become US citizens under the 14th Amendment.
However, Hoda’s father stopped being a diplomat five months before she was born. That’s the crux of her bogus citizenship claim.
Mike Pompeo: ‘She Is a Terrorist’
Four years ago, Muthana ran away from her Alabama home to join ISIS in Syria. She is currently living in a refugee camp in Syria. She claims that she regrets joining ISIS and wants to return to the US.
In February, Secretary of State Mike Pompeo issued a statement saying Muthana has no right to be in the United States, and refused her pleas to return with her 18-month-old son:
“She is not a U.S. citizen. She has no claim of U.S. citizenship. In fact, she is a terrorist. We should not bring back terrorists to the United States of the America. President Trump is determined she will not come back.
She does not have any legal basis, no valid U.S. passport, no right to a passport, nor any visa to travel to the United States.”

Treason Can Result In Revocation of Citizenship
The US government says it issued a US passport to Hoda Muthana in error. Her lawyer claims this is a “flawed constitutional argument.”
“You can’t revoke citizenship on that basis. The Supreme Court said that the loss of citizenship is not a punishment.
It’s conferred by the 14th amendment. It can’t be taken away absent very unusual circumstances and absent a judicial action, none of which have occurred.”
When asked if he thinks Hoda Muthana has a strong legal case, her lawyer replied: “I feel like I have an excellent case.”
When asked if Muthana is a danger to the United States because she was a terrorist, her attorney insists that if she did commit terrorism after returning, law enforcement could just prosecute her. Of course, by then, she might have murdered a bunch of people.
“I expect this case to be resolved in the next few months on the first stage. I put trust in the ability of law enforcement to prosecute if she commits criminal action.
We can’t remove people from the United States who are citizens because we are concerned they might be dangerous.
I am not here to defend her actions. I am here to defend her citizenship.”
Muthana Fomented Violence Against USA
Earth to Hoda Muthana: Under federal law, anyone’s US citizenship can be revoked if she commits “any act of treason against” the United States. It’s an easy argument to make that running away to join ISIS is an act of treason.
In 2015, Muthana promoted violence against the United States by urging people on Twitter to kill Americans on national holidays:
“Americans wake up! Men and women altogether. You have much to do while you live under our greatest enemy.
Enough of your sleeping! Go on drivebys, and spill all of their blood, or rent a big truck and drive all over them. Veterans, Patriots, Memorial, etc day. Kill them.”
