Dems furious when Trump-nominated judge is appointed to liberal 9th Circuit without their blessing

Democrats are furious after the Senate confirmed President Trump’s nominee, Eric Miller, to be a judge on the leftist 9th Circuit Court of Appeals. The addition of Miller is a small step toward balancing out the leftist judicial activism the 9th Circuit is known for.

Miller — a Seattle attorney who worked at the white-shoe law firm of Perkins Coie — was confirmed by the Senate in a party-line vote of 53-46.

Judge Miller will replace Judge Richard Tallman, a Bill Clinton appointee.

Dems Want Trump to Nominate Leftist Judges

The White House ignored the objections of Washington state’s two Democrat senators, Maria Cantwell and Patty Murray, in nominating Eric Miller.

Naturally, Democrats are upset that President Trump nominated his own choice of judge rather than take their advice to add yet another liberal jurist to the already left-wing bench.

“This is wrong. It is a dangerous road for the Senate to go down,” Murray said on the Senate floor Feb. 26.

“Confirming this 9th Circuit court nominee without the consent or true input of both home-state senators, and after a sham hearing, would be a dangerous first for this Senate.”

9th Circuit Is Known For Judicial Activism

What Democrats are really upset with is that a conservative judge has been added to the leftist 9th Circuit.

President Trump has slammed Democrats for constantly filing motions opposing his executive orders in the Ninth Circuit because they know the activist judges on that bench will block everything he does.

Of course, those decisions get appealed to the US Supreme Court, and then usually get overturned. The Ninth Circuit has a pitiful 79% reversal rate, which means the top court in the country (the US Supreme Court) is saying the circuit court’s rulings were wrong most of the time.

This whole appellate process wastes taxpayer money and everyone’s time, but has been an effective way for Democrats to obstruct President Trump.

 

Trump: Judges Should Not Legislate From Bench

In November 2018, President Trump blasted the judicial activism of the Ninth Circuit, when it overruled his plan to only accept asylum requests at ports of entry on the US-Mexican border (instead of giving refuge to illegal aliens who sneak across our porous border):

“A vast number of their decisions get overturned. It’s a shame. It’s a disgrace. Essentially, they’re legislating. They’re saying what to do.

Some judge, sitting in some location very far away, is telling our incredible military and law enforcement what to do. It’s not right, and it’s been going on like that for a long time.

Our Congress is going to have to get together and stop it. Because they’re taking advantage of our country by filing always in the Ninth Circuit. Even our legislation that we did have passed, it failed in the 9th Circuit. It then won in the Supreme Court.”
