On Friday the Alabama Supreme Court issued an astounding ruling that could potentially lead to the reversal of Roe v. Wade, the landmark 1973 ruling that legalized abortion.
The case the court ruled on, Jessie Phillips v. State of Alabama, concerned a man who was sentenced to death two years ago for the murder of his pregnant wife, Erica Droze Phillips, and their unborn child.
After his conviction, Phillips appealed his sentence on the grounds that he’d only murdered one person versus two, his point being that his unborn baby shouldn’t have been counted as a person.
This appeal was an attempt to reverse the Brody Act, a state law reportedly enacted twelve years ago that designated the murder of any unborn baby a punishable homicide.
In Friday’s unanimous ruling, the court struck down his appeal on the basis that “the value of the life of an unborn child is no less than the value of the lives of other persons,” according to LifeSiteNews.
Given the existence of the Brody Act, this ruling wasn’t surprising. What did shock many was a separate opinion penned by Alabama Supreme Court Justice Tom Parker in which he explicitly urged the national Supreme Court to reverse Roe v. Wade.
“Today, this Court adds Alabama’s capital-murder statutes to the growing list of Alabama’s, and other states’, broad legal protections for unborn children. In so doing, we affirm once again that unborn children are persons with value and dignity equal to that of all persons,” he said.
“The Roe exception is the last remaining obstacle to the states’ ability to protect the God-given respect and dignity of unborn human life,” his ruling continued. “I urge the Supreme Court of the United States to reconsider the Roe exception and to overrule this constitutional aberration. Return the power to the states to fully protect the most vulnerable among us.”
The implications of this ruling could potentially be monumental.
“The national significance of this case cannot be understated, since the question of personhood has been the lynch-pin to the so-called right to abortion, ever since Justice Blackmun erroneously wrote in Roe v. Wade that children in the womb are not persons and therefore not entitled to any of the fundamental constitutional protections,” LifeSiteNews noted.
Parker also referenced the prior court’s flawing logic, noting that its 1973 ruling had been made “without historical or constitutional support” and in violation of “the natural law and the positive and common law of the states.”
“Of the numerous rights recognized in unborn children, an unborn child’s fundamental, inalienable, God-given right to life is the only right the states are prohibited from ensuring for the unborn child; the isolated Roe exception, which is increasingly in conflict with the numerous laws of the states recognizing the rights of unborn children, must be overruled.”
This matters more-so now than ever before because one, America currently boasts a pro-life president, and two, the Supreme Court features a conservative majority for the first time in decades, thanks to the president’s successful nominations of Justices Neil Gorsuch and Brett Kavanaugh.
Because of all the “good news” — the justices’ confirmation plus the Alabama court’s ruling — pro-life Americans are more confident than ever that Roe v. Wade could really wind up being reversed.
