Chuck Grassley, the chairman of the Senate Judiciary Committee, dismissed the latest Democrat talking point that Brett Kavanaugh’s team tried to “tamper” with witnesses based on alleged text messages shown to NBC News.
“The texts from Ms. Berchem do not appear relevant or contradictory to Judge Kavanaugh’s testimony,” Grassley pointed out in a statement. “This appears to be another last-ditch effort to derail the nomination with baseless innuendo by Democrats who have already decided to vote no.”

Grassley was referring to the latest desperate accusations that Kavanaugh’s team may have texted former Yale classmates shortly before Deborah Ramirez told the New Yorker magazine on September 23 that Kavanaugh may have exposed himself to her at a college party in the 1980s.
A woman named Kerry Berchem, who claims she knew both Kavanaugh and Ramirez at Yale, emailed an FBI agent involved in the seventh Kavanaugh background check, asking them to look at the text messages, NBC News reported.
Instead of showing the texts to readers, NBC tried to characterize them in the light least favorable to Kavanaugh.
NBC insists the text messages between Kerry Berchem and Karen Yarasavage (another Kavanaugh friend) implied that Kavanaugh’s team had tried to contact them before the New Yorker published its story about Ramirez’s sketchy allegations.
As BizPac Review has reported, Deborah Ramirez — like Christine Blasey Ford — could not remember specific details of the alleged incident and confessed that “there are significant gaps in her memories of the evening” because she was drunk at the time.

According to the New York Times, “Ramirez herself contacted former Yale classmates asking if they recalled the incident and told some of them that she could not be certain Mr. Kavanaugh was the one who exposed himself.”
Moreover, the New Yorker magazine admitted that it did not confirm with other eyewitnesses if Brett Kavanaugh was even at the party in question.
Anti-Trump pundits on Twitter immediately promoted the narrative that Judge Kavanaugh was guilty of “witness tampering” or perjury, based on the NBC News report.

Based on these facts, we can't say that Kavanaugh has engaged in witness tampering. We *can* say that it's grossly inappropriate for a sitting judge to contact potential witnesses against him.

Meanwhile, Kerry Berchem (whose text messages are the subject of the liberal innuendo about witness tampering) issued this statement, saying she has no idea what Ramirez is talking about.
“I have no direct or indirect knowledge about any of the allegations against him,” said Berchem, a partner at the law firm Akin Gump. “However, I am in receipt of text messages from a mutual friend of both Debbie and mine that raise questions related to the allegations. I have not drawn any conclusions as to what the texts may mean or may not mean but I do believe they merit investigation by the FBI and the Senate.”
Here’s the definition of witness tampering:
Generally, “witness tampering” involves threatening or intimidating witnesses involved in criminal or civil proceedings or in proceedings before Congress or government agencies.
Texting someone (allegedly) before a media hit piece is none of these. So where’s the smoking gun?
