It helps to have friends in high places, especially if you’re Hillary Clinton.
The White House may be laying the groundwork to pardon Clinton before lame duck President Barack Obama leaves office in January.
At least that’s what press secretary Josh Earnest suggested when asked by a reporter if Obama will pardon Clinton in light of President-elect Donald Trump‘s vow to jail her when he takes office.
Clinton has not yet been charged with a crime, but Obama could pre-emptively charge her so he could pardon her before he leaves. Hillary could not be charged again under a Trump White House because of double jeopardy.

Earnest did not rule out the possibility of a last-minute pardon for Clinton.
“The president has offered clemency to a substantial number of Americans who were previously serving time in federal prisons,” Earnest said.
“We didn’t talk in advance about the president’s plans to offer clemency to any of those individuals, and that’s because we don’t talk about the president’s thinking, particularly with respect to any specific cases that may apply to pardons or commutations.”
Clinton has been embroiled in two ongoing FBI investigations during the past two years: One was over her use of a private, unsecured email server to conduct State Department business. FBI Director James Comey recently closed that investigation.
But a second FBI probe into the Clinton Foundation‘s alleged pay-to-play scheme is still pending.
Former DOJ attorney and ex-NYC Mayor Rudy Giuliani said “there’s no question” that Hillary Clinton and her aides intentionally broke the law when they mass-deleted 33,000 emails and BleachBit’ed her server after receiving a Congressional subpoena to preserve evidence.

Giuliani, who said that he prosecuted and jailed thousands of people for doing a fraction of what Clinton did, said the Wikileaks email dumps prove the Clinton camp intended to break the law.
“There’s no question anymore as to whether or not Hillary Clinton, [Huma] Abedin, and [John] Podesta violated the law,” Giuliani said. “You’d have to be almost stupid not to realize it.”
