Despite Hillary Clinton openly laughing at the possibility of being indicted over her private email server and Democratic National Committee chairwoman Debbie Wasserman Schultz dismissing the notion as “ludicrous,” Judge Andrew Napolitano has a differing point of view.

“Tell that to the more than 100-plus FBI agents and other officials in the Justice Department who have been thoroughly investigating this for nearly a year now,” the judge said of the DNC chair’s remark.

Napolitano also countered an attempt by Clinton to downplay the ongoing investigation as a “security review.”

“This is about as serious an investigation as there could be,” the Fox News senior judicial analyst said.

“The FBI doesn’t do security assessments, the State Department does,” Napolitano added. “The FBI does criminal investigations.”

He also disputed FBI Director James Comey’s latest assessment that there are no “time pressures” in reaching a determination from the Clinton investigation.

“The American public and the Democratic Party need to know if they’re about to nominate someone who might be a defendant in a criminal prosecution,” Napolitano argued.
