In what looks to be a consistent theme in Baltimore, the decision to settle with the family of Freddie Gray prior to the trials of the six police officers charged in his death is raising plenty of eyebrows.

Among those questioning the approval of a $6.4 million settlement is Fox News senior judicial analyst Judge Andrew Napolitano, who says the cops charged in the case will not get a fair trial.

(Assuming a fair trial is possible, given Baltimore City State’s Attorney Marilyn Mosby.)

Appearing Wednesday on “The Kelly File,” Napolitano said the standard rule of thumb in cases likely to see both civil and criminal litigation is for the criminal case to go first.

“You don’t want to do something in the civil case that would prejudice the fairness of the criminal case,” he said.

Unless it’s Baltimore.

Then again, given the shaky case Mosby is expected to present, she could probably use all the help she can get.

Napolitano said the settlement equates to the city all but admitting liability for Gray’s death, with such an appearance making it impossible to find an impartial jury.

And he placed the onus squarely on Mayor Stephanie Rawlings-Blake.

“It’s an example of a mayor misusing her office,” Napolitano said. “It’s an example of the mayor setting an atmosphere in which a fair trial is nearly impossible.”
