A homeowners association is threatening a Missouri family with jail time over a backyard play set the parents installed for their daughters.
The problem? They painted it purple.
“There’s nothing in the rules about color,” UPI quoted Maria Stout as saying. “What it says is it has to be harmonious with the community and with nature, and there is nothing that dictates the color of the swing set.”
Her reasoning was that purple is harmonious with the leaves of autumn.
Stout said the family installed the playground equipment about two years ago. About a year afterward, they were fined for not having both the play set and its color approved by the association.
They fought that decision and won. Now the association is talking jail time.
It sent letters saying “that if we didn’t remove the swing set from the subdivision in a couple of weeks, we go to jail,” Stout told KMBC Channel 9 News. Another letter promised that a lawsuit would cost the Stouts “greater than any principle you are trying to prove.”
A petition of support signed by over a dozen of the Stouts’ neighbors was ignored by the association, the family said. They hired a lawyer and vowed to continue the fight.
