A Florida man was sentenced to two-and-a-half years behind bars Monday for having sex on a public beach.
On July 14, we reported that Jose Caballero, 40, and his “partner in crime,” 21-year-old Elissa Alvarez, were arrested and charged with lewd and lascivious behavior after a grandmother took video of them engaging in sexual intercourse within eyeshot of children.
Both Caballero and Alvarez are both now forced to register as sex offenders, but while Alvarez was sentenced to time served, Caballero’s sentence is tougher because he previously served eight years on drug charges and was facing 15 years in this case, according to WWSB.
“Even though Mr. Caballero did, pursuant to the Florida Legislature, warrant the 15 years, our office had discretion,” State Attorney Anthony Dafonseca said. “We felt two-and-a-half years not only held him accountable but also reflected his past history as well.”
Maybe next time they will get a room.
