Federal judge rules Chicago ban on gun sales unconstitutional

A federal judge ruled Monday that a Chicago ordinance banning the sale of firearms within city limits “goes too far” and declared it unconstitutional.

U.S. District Judge Edmond Chang rejected the city’s argument that banning gun sales by licensed dealers was a necessary step to reducing firearm violence, according to the Chicago Tribune.

“Chicago’s ordinance goes too far in outright banning legal buyers and legal dealers from engaging in lawful acquisitions and lawful sales of firearms, and at the same time the evidence does not support that the complete ban sufficiently furthers the purposes the ordinance tries to serve,” Chang wrote.

The city approved the ordinance in 2010 after the U.S. Supreme Court struck down an even stricter law prohibiting the possession of all firearms in the city. The measure also prohibited the transfer of firearms already in the hands of Chicagoans by private sale or even as a gift to family members. Ownership of firearms could only be transferred by inheritance.

According to the Tribune:

The ruling stems from a 2010 lawsuit filed by three residents and an association of Illinois firearms dealers.

The suit alleged the city’s revamped ordinance violates the right of Chicago residents to keep and bear arms under the 2nd and 14th Amendments….

The crux of Chang’s reasoning in his 35-page opinion was that the Second Amendment right to bear arms has little substance without the means to actually acquire weapons.

Although Chicago’s gun laws are among the strictest in the nation, they have arguably done little if anything to curb the high incidence of firearm-related crime the city has become known for, especially in its South Side neighborhoods.

As extreme as an outright ban on gun sales may seem, it’s not the most heavy-handed of Chicago’s tactics.

Chicago Mayor Rahm Emanuel wrote letters to Bank of America and TD Bank a year ago, asking them to cut off any business dealings with gun manufacturers. He hoped to force the weapons companies into supporting restrictive gun control measures. At the time, Smith & Wesson had a $60 million line of credit with TD Bank, and Sturm, Ruger & Co. had a $25 million line of credit with Bank of America.

Emanuel, who left his post as President Obama’s chief of staff in late 2010 to run for mayor of Chicago, is a member of Mayors Against Illegal Guns.

He has not a clue how to run a city like barry has not a clue how to run a country! It is laughable that he tried to get banks to cut off credit to the gun companies!!! Crime in this city is one of the highest in the world and he is trying to disarm people. If people ever needed to own guns for protection it is in this city of crime and corruption!! Thugs and queers who run this city!!! UGH!!!

      You are right. This point in confirmed in their personal correspondence on the subject. The 2nd Amendment is intended to defend against a tyrannical government; one that forces the will of the political elite onto The People, who are the real and only sovereignty in the United States.

    UH, Hello, Every Judge I know, is Armed, just think about it, the friends and families of those that they sent to prison or to death would love to put the judges to death. They make so many really dangerous enemies that it would be suicidal to be unarmed.
    And to those that say, Oh but they are the MOST responsible people and would never use their guns for illegal activity.
    Check out some History in Daytona Beach, Florida, the Chief Judge had several incidents where She brandished her gun at some people with a threatening manner and one of those incidents was just over a parking space. The incidents cost her the office and she is now in Private Practice. Don’t get me wrong, she was a Great Judge, but to show possibly a few things, I will let you guys figure out what those are.
    My real point is, they think that only they in the legal system such as Police and Military as well as some public officials are the only ones that should carry guns, because they would only use them responsibly and properly, I say anybody is human and can make mistakes, but Legal gun owners make fewer mistakes with guns than do those that get their hands on one that they cannot use to get proper training or practice with.
    Basically what I am saying is, that most, Legal gun owners understand that there may be a very big price to pay if they act irresponsibly with their guns or make a mistake, unlike the criminal that just wants the Power that they think a gun gives them and since what they are already doing is criminal what is just another charge?
    I really think, to deter crime, guns need to be worn like the Old west, openly viewed by responsible gun owners, just to let the criminals know the potential outcome of their untrained actions would meet up with well trained legal response without the time lapse waiting for the POE POE. Because Criminals conceal their guns, when law abiding citizens accidentally see a concealed legal weapon they freak out.
    Real gun control, should be Real consequences for using a gun in a crime. The 10, 20, life law was BS, it should have included DEATH, then it would have been something to think about before carrying a gun.

    A good sign! Never thought I would be amazed at such a ruling as always thought it was ‘automatic’. Continue your support of the NRA, as Obama still has the UN Treaty sitting on his desk that needs Senate approval of 2/3. 2014 is important for so many reasons!!
