Before IRS, Lerner sued Christian Coalition in largest FEC action in history

Lois LernerUnder the direction of Lois Lerner, the Federal Election Commission undertook the largest enforcement action in its history when it sued the Christian Coalition for violating campaign laws.

During a deposition in that trial, FEC attorneys inappropriately asked a defendant if Pat Robertson prayed over him. The FEC eventually lost the lawsuit, which was filed in July 1996, during the Clinton administration.

Lerner, the IRS unit chief overseeing tax-exempt applications, finds herself in the news again this week after invoking her Fifth Amendment right against self-incrimination instead of testifying before Congress.

James Bopp, an attorney for the Christian Coalition, said he became concerned when he learned that Lerner had been promoted to a position at the IRS.

“She was being, in effect, promoted for what she had done at the Federal Election Commission and was now going to be expected to… replicate that at the IRS, and now we know that’s exactly what happened,” Bopp said.

As more information surfaces in the ongoing IRS scandal, the insistence by some that it was not politically motivated becomes less and less plausible.
