Krauthammer: Obama’s fast track on regulations could be ‘illegal and unconstitutional’

In February 2011, President Obama ordered a sweeping review of the federal government, saying to the U.S. Chamber of Commerce that, “if there are rules on the books that are needlessly stifling job creation and economic growth, we will fix them.”

However, according to Regulations.gov — which bills itself as “your source for information on the development of federal regulations and other related documents issued by the U.S. government” — the feds have posted thousands of new regulations in the past few months alone. The breakdown:

  • Wednesday (183)
  • Last 3 Days (183)
  • Last 7 Days (357)
  • Last 15 Days (983)
  • Last 30 Days (2,032)
  • Last 90 Days (5,745)

Many of these regulations are several hundred pages long. The Obama administration, meanwhile, has shortened the period during which the public can comment on proposed regulations from 60 days to 45 days, or less in some cases, according to Fox News.

“At so many levels, it’s a problem,” Fox News contributor Charles Krauthammer said, noting that the sheer volume is overwhelming and businesses have no idea what to expect.

Second, he said the intrusiveness is a burden for small businesses that don’t have lawyers and accountants to work their way through the regulations. The lack of transparency is a problem, since the administration has shortened the comment period, which means the executive is running it.

“Lastly, you get the arrogance of the administration essentially enacting legislation on its own through regulation the way it did the Dream Act and the way it did in stripping away the work requirement in reform of welfare,” Krauthammer said. “All of these things happening unilaterally. A lot of them, I think, are illegal and unconstitutional.”
