Parents sue Oregon high school after a girl uses the boys’ bathroom

Parents have sued an Oregon school district over a policy allowing males and females to use the bathroom of their choice, regardless of biological sex.

The parents filed a lawsuit this week against Oregon’s Dallas School District, where current policies let transgender students use the bathroom that fit the kid’s gender identity, Fox News reported. The lawsuit comes after school officials allowed a 16-year-old biological girl, Elliot Yoder, to use the boys’ bathroom and locker room, because she identifies as a male.

The district’s policy violates the rights of most students who are not transgender, says Herb Grey, an attorney for the parents of three former and current students at the district.

“The key to this whole thing is not just the privacy and the rights of just one student,” said Grey. “It’s the rights of all the students and their parents and you can’t interpret federal law and state law and impose it on everyone else and say you’re accommodating everyone — because you’re not accommodating everyone.”

The boys using the locker room and bathroom have become embarrassed changing in front of a biologically female student, Grey added.

Oregon’s American Civil Liberties Union held a press conference Thursday to decry what it considers a malicious lawsuit intent on stripping the rights of transgender students in the school district. “The case targets transgender youth for simply existing and seeking an education,” said Oregon’s ACLU legal director, Mat dos Santos. “This lawsuit is senseless and cruel but it is not a meaningful threat to the right of transgender students in Oregon.”

Yoder lives with an adoptive family and has a girlfriend, according to Fox.

“What’s really troubling and what really scares me is this lawsuit,” Yoder said. “When a transgender student is using the facilities that match their gender identity, the only person’s privacy that is being interrupted is their own because of everyone else’s concerns about it.”

This lawsuit comes after a teacher in England was recently suspended for accidentally referring to a transgender student as a girl, saying “well done girls” to two students, one of whom identifies as a boy, the Evening Standard reported.
