In an “oops, didn’t see that one coming” moment, former Dolphins receiver Chad ‘Ochocinco’ Johnson was about to walk out of a Broward county courtroom Monday with a stern warning for violating his probation when he made an innocent gesture that infuriated the female judge.
The sentence came down as a result of a violation stemming from a domestic violence charge reported in August.
A debate is quickly swirling over whether Judge Kathleen McHugh acted unfairly when she abruptly rejected the terms of the pending plea deal. It all got ugly when Johnson responded to the judges comment that he should be very thankful to his attorney.
Apparently his gratitude overwhelmed him because he smacked the attorney on his butt as a sign of appreciation, causing the courtroom observers and staff to be audibly amused. The judge was not. Visibly angry, McHugh punished Johnson for his actions by rejecting his plea negotiations and sentencing him to 30 days in jail.
“Mr. Johnson, I don’t know that you’re taking this whole thing seriously – I just saw you slap your attorney on the backside,” McHugh said before remanding him to county jail. “I’m not going to accept these plea negotiations. This isn’t a joke.”
The August incident led to the dismissal of Johnson from the NFL team. Here’s how it was reported by CBS Sports.com:
According to the newspaper, the incident occurred in a vehicle when Johnson allegedly head-butted his new wife, Evelyn Lozado, in the middle of an argument. When police arrived, she apparently had lacerations on her forehead. Johnson was then arrested.
“It gets pretty heated,” Davie police captain Dale Engle told the Sun Sentinel. “By the time they get home here in Davie, it’s pretty heated. She alleges he leaned over and head butted her. He says she leaned towards him and that they butted heads. Needless to say she has a good laceration on her forehead.”
