Colorado prosecutors will seek the death penalty against James Holmes for the Aurora movie theater shooting on July 20 that killed 12 and injured many others.

The announcement came Monday from District Attorney George Brauchler during a court hearing, the Denver Post reported.

“It is my determination and my intention that in this case, for James Eagan Holmes, justice is death,” Brauchler said.

“Holmes is charged with 166 counts of murder, attempted murder and other offenses in connection with the attack,” the Post reported.

According to ABC News, prosecutors rejected Holmes’ offer last week to plead guilty and face life in prison.

Brauchler said he consulted with the more than 800 victims and “had personally spoken with relatives of 60 victims who died and were injured” when making the decision to pursue the death penalty for Holmes.

The trial is scheduled for Aug. 5.
